Way back in 2004 our neighbor filed a case of grave threats against my husband. The case dragged on for 6 years with no aggravating incidents between my husband and the complainant. The complainant had no other witness aside from his wife still the judge found my husband guilty beyond a reasonable doubt citing consistency as the reason she favored the complainant. Today my husband was sentenced to 3 months in jail and a fine of 300. We paid a bail bond of 4000 pesos for temporary release while we are considering whether we would appeal the case or file for probation The PAO lawyer suggested that we file for probation but we are afraid that it will not be granted. What do you suggest we do? file for probation or appeal the case? If we file for probation what do you think would be our chances of being granted probation?

there are never any guarantees, but it is very likely the judge will grant probation
