Good morning!

Ask ko lang po kung pwede na po ang recorded conversation sa cellphone na evidence regarding grave threat. Yung kasamahan ko po kasi sa trabaho e pinagmumura ako at sinabihan na papatayin ako. Nagtext po kasi sya earlier na kaya nya daw ako patayin. Kaya nung tumawag sya, minabuti ko na irecord ang conversation namin. Paulit-ulit nya sinasabi na "Papatayin kita."

Pero pag nakainom po ang isang tao na magsasabi sayo na "papatayin kita," mapapawalang sala po ba sya sa korte?

that would be a violation of the anti wire tapping act if you cannot prove that he knew and consented to the taping of the conversation. not only will it be inadmissible, it makes you criminally liable.

Ah ganun po ba. Dapat pala pinaalam ko na nirecord ko ang conversation namin. So yung sa text na lang ang pwede magdiin sa kanya at saka yung mga kasamahan namin na kasama nya nung mga panahon na yun ang magtetestigo na sinabi nya na "Papatayin kita", tama po ba?

It was said earlier that the recording is illegal but the acts that gave the threat is illegal. Ipa blotter ninyo po sa pulis o sa barangay ung sinabi nia. Para po may evidence po ung pulis sino po ang hahanapin nila just in case.
