hi. i posted here before about grave threats. luckily the parents of my gf did not pursue to bring the case on court provided that i would sign a waiver not to get near their family, to my 1 year and two months baby and my gf. that was really a relief. but last week, i recieved a letter from my gf telling me that she already had decided to go and live with me with our baby.and she was asking me to help her find a way to escape from their house. so, as a father, i took the risk of writing back a letter (i ignored that it would jeopardize the waiver that i signed) telling her to wait for i have to prepare everything for it is not easy when your starting to live with your own. but soon after she read the letter, she threw it on the garbage without caution. then her younger saw the crumpled letter and read it to her mother. her mother cried and pretended to faint ( as the other witness/ neighbors said)..my gf was told by her mother not to be or go with me coz if she'd do that, she''' not be acepted as a part of the family and she would be blamed if her mother died beacause of sadness..her mother took the letter and let our heighbors read it. they were laughing and so on the comments. my question is, could it be possible that they would now bring the case on higher court? i know i committed a mistake that i wrote back the letter of my gf, but i guess it was the right thing to do for a father of our daughter.Do i have a chance if it would be brought on court? i know my gf loves me but she is very afraid of her family. i have her 3 letters and it would be an evidence. earlier, i recieved a txt message from an unknown number. i was threatened not to deal with my gf's family or well be in hell.it also like kinda big insult for me because it includes or tell me to find another girl coz it said that im a good looking dude ...but im not a good looking man?.can i use the text message to sue them back? it seems that they wanna put a fight or encouraging me to play there game..i hope you coul help me find a way to get through this...all i want is my right to visit my daughter. tnx in advance

i recommend you bide your time instead of meeting them head on. if the girl is of legal age, there is no legal impediment that you both will be together at some point. nevertheless, i hope you are able to reconcile with the parents at some point.

my advice is the same.

it will be hard to use those text messages because you can't prove who sent them.

you can file a case at the bgy to enforce your visitation right to the child. did you sign the birth certificate?

i was not able to sign the birth certificate beacause the mother of my gf changed it. here is the story, immediately a day after my gf gave birth at our rural health unit clinic. me and my gf decided to register our baby at the municipal hall. so i fill-out the form coz we already agreed on the name of the baby. then i let the midwife signed it and of course me and my gf signed too. the midwife advised me to let the baby have my surname hence me and my gf had already agreed on it and of course i acknowledge it as my daughter.then before i submit it on the LCR, i hand it over to the mother of my gf and let her do the honor of submitting it to the LCR, but she didn't react on the surname of the baby. so, i guessed that was ok for her. i thought it would NOT be a problem coz it was "our "(me and my gf's) decision or agreement.but i was unaware on that same day, in the afternoon, her mother did go back to the municipal hall and took back the form and she filled out another form and she changed the surname to their surname.i dont know why the people at the registrar let her do that when infact she has no rights to do that. i asked the officer and they said that the lady insisted so they gave it back. so, that starts the fire between us. i feel like it was an insult. why she didn't react when she read it before we submit it? i already signed a waiver im afraid to, call them up at the brgy. and i know that i can't really asked for visitation rights for the baby coz my name was not on the birth coz they already changed it..i know that i can't do anything now..im so frustrated coz i know my gf is suffering right now too but she could not leave. so sad coz me and my gf have the same plan for our family but her family would not let it happen..your right, i will let time do its part of this bizaare love story. thanks a lot..GOD bless

go visit the Local civil registrar and ask them for the forms and their requirements regarding issuing an affidavit of acknowledgment and an authority to use surname of the father (ausf). normally they require the mother to appear. if you are successful and it is forwarded to the nso, they can't simply change it back.

thanks but i guess its too late. im sure that it has already been forwarded to the NSO. My baby is 1 year old already. ive been to the LCR already and they told me that we cant change it anymore. I've been to DSWD too to help me regarding visitation rights but they also said that i can't really insist on my rights because i was not even acknowledge as the father or my name was not written at the back of the form. So..so..sad. I've been dealing this problem for quite sometime. it really hurts me to think that i could not even get close to my baby girl.Legally, i think i dont have a single chance to have them. Thank you so much for your advice.It really is a big help for people like me that has no other person to ask advices. God bless

really? are you sure? and if they normally require the mother of my baby,i guess iw would be very impossible for my gf to be at the LCR because she is not allowed to leave the house. she is always "guarded" all the time. i know this is unbelievable but this is true. Her parents are totally insane

moderator

the procedure for the AUSF is to merely stamp the birth certificate with an annotation. why not inquire at the civil registrar so you can determine yourself.

i found something on the web about changing surname of an illegitimate child and it requires
1. certificate of live birth with accomplished Affidavit of Acknowledgment/Admission of Paternity at the back;
* i don't have the live birth. even if i had the live birth, my name was not written at the back as i said before.
2.public document
* what is a public document?
3. AUSF, including all supporting documents.

..i will find time to go to the LCR to asked for the requirements. thanks! you've been a great help
