Hi, I and my husband were involved in road right to pass dispute. we use to pass this lot as all other people are using the same road 6 years or more already.

yong katiwala sa lupa, eh hindi namin kilala, naglagay ng kawayan na post in the middle of the road to where we use to pass, because they intend to fenced it accordingly yon ang instruction daw ng boss nya. dumaan kami.. biglang sinita kami, galit na galit. syempre nagalit din asawa ko, ganito ang sabi.. wala panga kayo maipakita na fencing permit nag lagay na kayo ng post dyan, sa likod po kami nakatira, wala kami madaanan na malapit dahil papunta kami church noon..

nagkainitan na ng ulo... sinabi tinangal ng asawa ko ang isang post para maka daan kami ... galit ang asawa ko at nasabi HINDI AKO PAPATOL SA IYO DAHIL PISO KALANG... BASAGIN KOPA ULO MO"

yong katiwala na yon eh isang real estate broker...hindi namin siya kilala.. naghearing na kami sa kapitan dahil mag sampa daw siya kaso ng grave threats.

mayron ba siyang advantage if mag file siya ng grave threats? ano penalty ng court nito if ma accused ka?
ano pwede namin esampa kaso sa kanya.

try to reach a decent settlement at the barangay level. deny that he ever said that if there is some truth to this. maybe what he said was basagin ko pagka-ulol mo! nevertheless, i don't recommend stating any falsehood.

the most you can argue for putting up the fence is unjust vexation, if it was with intimidation, then coercion. good luck.
