Good Day,
Meron sana akong i-consult at hingan ng opinion tungkol sa aking termination na walan naman notice or document.

Nangyari ito nung december 14 and it's past two months na rin kasi wala akong pwedeng matanungan. Ganito po ang nangyari.

1. Hire nila ako effective Oct 27 na walang binigay na employment as Accounting Supervisor. After two weeks, tinanong ko sila bakit wala pa rin ang employment contract ko. After two weeks ulit, lumabas na ang contract pero hindi na Accounting Supervisor ang nakalagay. Ginawa na nilang General Accountant at yung contract, binura ng tape eraser at pinatungan gamit ang typewrite.
2. Tinanong ko sila bakit pinalitan ang designation ko instead kung ano ang nakalagay sa company id na inisyu nila. Ang masama pa nito, kitang kita ko ang pag alter ng contract na hindi ko pa pinermahan. Ang sabi pa ng HR kasi daw nag usap na kami ng manager na tanggapin ko ang work ng isang general accountant na (tinerminate din nila nung Nov. 9) in addition sa pagiging supervisor ko.
3. Nung pagkaalis ng general accountant after the day na pinaalis nila, binigay na sakin ang mga work na hindi naman namin inaral ng general accountant dahil absent siya for the whole week after I was hired. Meaning, from Oct 27 to Nov. 2 lang kami nagsama at meron pang holiday in between those dates.
4. Pagkadating ng middle of november, may pinapagawang backlog ang manager ko sakin na dapat work ng cashier nila na ayaw niya naman kausapin dahil mahina daw sa accounting at walang alam. So bilang supervisor, pinilit kong aralin ang work ng cashier to satisfy the requirements of the manager. Syempre, dahil hindi lang naman ang work ng cashier ang ginagawa ko, pati ang mga review ng payments and billings din ang ginagawa ko. Plus, kulang na kulang talaga sa tao considering umuuwi na kami everyday ng 9:00 pm.
5. Nung nag submit na ko ng report na yun, I was assuming na tama na kasi ang sabi ng system analyst namin, tama na at wag galawin ang system, just execute the report and check kung ano ang cheques na cleared at hindi cleared sa bank. Knowing na wala naman akong alam sa system, kinapa ko sya on my own then I was really assuming na tama siya kasi for that whole week, wala naman sinabi na may mali ang ginawa ko kasi mismo ang cashier na dapat gumagawa ng work na yun hindi rin pala alam.
6. Kinausap ako ng boss ko nung 1st week of December 2010 telling me na "You have been with the company for a month and half now and I assume you already know all of these things etc but I didn't see anything at all. Parang lahat na ginagawa ko at nang mga staff kay mali. No wonder why ang mga staff nawawala at hindi na pumapasok kasi binabastos niya at kung ano ano ang sinasabi sa ibang department at sa mga applicants.

Now, nung December 10, na-trangkaso ako at nagpaalam ako sa kanila dahil tinitext ko naman ang staff ko na sabihin sa HR at sa boss ko. Nagrereply naman sila sakin na okay na. Pagkapasok ko nung December 14, dun niya ako last kinausap. Ang tinanong niya kung natapos ko na ang report na pinapagawa niya. Ang sabi ko, I'm still reconciling all cleared cheques against the system and bankbook kasi absent nga ako from Friday-Monday.

Alam niyo po kung ano ang sinabi niya... No need to complete all of these. I have made a decision with the management na we will fire you and you dont have to report bukas and so on tutal hindi mo naman pinermahan ang contract and dun pa lang sa contract nakita ko na ang attitude mo na parang dami mong questions"...

In this case po attorney, may capacity po ba akong mag file ng complain sa NLRC about this? Since wala akong contract of employment na hawak, would it still be a valid complain against the company?

Please advise po.

yes, it will still be a valid complaint. your main focus should be proving you are an employee even if there is no contract with evidence such as payslips, sss, employee ID.

your recourse is to file a complaint at nlrc

Hello Attorney,
Good Day.
I've been patiently sending emails to NLRC Manila but the messages keep coming back with fatal error. Ask ko lang po kung meron kaya other way to send my complain to NLRC kasi po umuwi muna ako ng Davao. Kung may pera na po ako pagbalik just for this purpose, may kailangan ba akong e-submit na affidavit of complain sa NLRC? I need to know po sana para one trip na lang ang pagpunta ko sa gerang ito.

changel, the proper way to file a complaint at the nlrc is to to go to their office and personally file a complaint. it just involves filling a form.

the process is you file complaint at nlrc, they will issue subpoenas to you and your employer. if no settlement is reached, you will file your position papers and replies. then it is decided. if you win, you will be granted backpay from the time you were terminated.
