Gusto ko lang po mag inquire regarding sa Employment Status ng isang employee namin dito.

Nagstart po siyang magleave ng March 14, 2017 until March 28, 2017. Given po na ang employee ay may PTO credits pa, maari po bang i-disapprove ng Immediate Superior ang filed PTO kahit po may naisubmit ang employee na supporting documents (Medical Certificate etc..) sa reason lamang na hinihintay pa ang confirmation galing sa company nurse?

Nakareceive din po ng Return To Work Order (RTWO) ang employee ng March 25, 2017. Dapat po bang mapadalhan ng Return To Work Order (RTWO) ang isang employee na nakaleave kahit na ito'y nagcall-in, nag advise at nagpasa ng documents?

March 29, 2017 bumalik ang employee para magresume sa trabaho na may fit to work pero ang sabi ng Immediate Superior niya ay wag muna pumasok at kausapin nalang muna ang HR.

Nag issue ang HR ang Due Process Form sa employee regarding sa kanyang absences upang maipaliwang ng employee ang kanyang mga leave at same day ay tinanggalan ng company access ang employee kahit Due Process Form pa lamang ang naissue dito.

At hindi daw makakatanggap ng sahod ngayong payout ang employee gawa ng 3 araw lamang ang nacredit na pinasok nito sa cut-off dahil dinisapprove ng Immediate Superior anng mga filed PTO at dahil hindi ipprocess ang payroll ng isang empleyado kapag less than 5 days ang ipinasok sa isang cut-off. Maari po ba nilang gawin ito?

Maaari po bang magreklamo ang employee sa DOLE tungkol sa mga pangyayaring ito? Ano po ang magandang gawin ng employee tungkol dito.

Nag issue ng RTWO kasi hindi ni recognize ng employer yung filed leave. Nothing wrong with issuing a RTWO. Whether or not the leave is valid is not affected by the RTWO.

Nag issue ang HR ang Due Process Form sa employee regarding sa kanyang absences upang maipaliwang ng employee ang kanyang mga leave at same day ay tinanggalan ng company access ang employee kahit Due Process Form pa lamang ang naissue dito.
- this is ok as long as you are not prevented from entering the wrokplace and are given a salary for those days.

- as long as makuha mo ang salary within 15 days pwede ito

I get fired by the management's assistant last Monday for reason: absences; not qualified for regularization; & other issues like pettycash used during my hospitalization while im on duty di dw approved by my manager.. I started working at this company last sept.1, 2016.

And last monday they fired me w/out any document/notification.,wants me to leave the office immediately.

I filed leave for tuesday, wed.,and thursday because i was fired verbally. They want me to come back on 31 march to receive my last pay and 13th month, and sign dw the quit claim and termination paper.

They talked to me tuesday said that i should make a resignation letter so i will not have a bad records. I said no.

Should i sign the termination and quit claim on friday?

Pls help. Thank u so much.
