Dear Sir,

Ako po ay naka bili ng lote sa isang subdivision at nailipat na ito sa aming mag asawa ang titulo. Pagkaraan ng 2 taon naisipan ko po i pa plot sa kaibigan kong architect ang lote base sa titulo lumalabas mo na palipaliwak ang technical description ng lote. nag punta po ako sa munisipyo at kahit mali ang TD ng titulo ang location number ng titulo sa Lot plan ng munisipyo ay tama. Ano po ba ang dapat kong gawin o hakbang upang maitama ang TD ng Titulo upang masigurado na hindi ito magiging problema sa huli?

You have to go to court to correct the entry on the title.

Dear Sir,

Maari ko po ba na malaman ang normal na paraan na ginawa ng korte o inutos para malaman ko po ang processo at maging handa ako kung ano mang documento ang maari nilang hingin bago ako humarap sa court?

A lawyer will have to prepare the petition for you. All you need is to show proof of the proper technical description.

You need to get the correct technical description from the Bureau of Lands.

Do not proceed to the court yet. You need first to execute an "Affidavit of Correction of Technical Description" then, file it before the office of Registry of Deeds where the property is located. But before that, make sure that you are the following documentary requirements:

(1) Original Owner’s Copy of the Title;
(2) Notarized Affidavit of Correction of Technical Description;
(3) Approved VSR/Survey Plan and Technical Description of the property (yung corrected na po ha); and
(4) Certified True Copy of Tax Declaration and its Tax Clearance.
