please help me ...
i was terminated due to breach of trust and theft. my co employee accused me of stealing her perfume dahil nakita s cctv n hinawakan ko ang bag nya. hinawakan ko ito dahil sa accidentally natabig ko so ibinalik ko lang sa sabitan nya - we are seatmates. pero ang sinasabi nyang perfume ay nasa loob ng bag nya so wala namang nawala. but then an NTE was issued, had one administrative hearing pero ang kasama duon ay 2 from HR and manager namin from Operations walang kasamang representative from Legal department. di ba dapat anyone not from the same department as mine kasi naging bias ang decision. isa pa when we viewed the cam wala pang 6 seconds kong hinawakan ang bag in which malabong mabuksan ito (with zipper) and makuha ang perfume na nakalagay sa loob pa ng box na about 4 inches. and wala ngang nawala.
ive been in the company for 6 years, without any bad record. ive received recognition 2x for my performance. from staff level, i was promoted to supervisor and had pending promotion to manager sana this year.
they did not.consider all of those and just believe on the accusation na wala namang bearing dahil WALANG NAWALA.
please do help me i wanted to clear my name

If you were Terminated already, that decision stays. All your allegations should have been raised during the admin hearing. Kung sa tingin mo e dapat my representative sa ibang legal department, this is valid. No need to get the services of the legal department if there are no grave cases that involves the Company.

Kung sa tingin mo e bias ang mga tao sa hearing e dapat dun pa lang e nagsalita ka na. Lahat sana ng mga objections mo e sinabi mo na sana sa hearing nyo. Kung tinapos niyo ang hearing na wala kang objective, the law views the same as regular. And as long as my due process na ibinigay syo the decision with viewed with regularity.

and paano po ung decision na may kasamang theft? e wala naman nga pong nawala, dun man lang po ba diko pwdng i contest? ang hirap ma accuse ng pagnanakaw kung wala namang nawala

to HRdude - first time kong naka receive ng NTE and aftr 2 days Admin hearing, i dont have the idea on the right process and personnels to be involve of the hearing committee. as ive said i am confident that i did no wrong. all those questions just came after receiving the decision in which un nga po may nakalagay na theft. thats the worst accusations - in the first place WALA NAMANG NAWALA, and i dont know if they also conducted an investigation to the accuser kung totoo nga ang sinasabi nito.
iyon po bang allegation of theft is not consider grave case?

1. Kung sinasabi mong walang nawala e napatunayan mo ba? Kung na-terminate ka, it is assumed na napatunayan nilang may nawala.
2. Kahit walang representative ng legal ay obligasyon mong i-contest ito. Kung hindi mo ito ginawa ay kasalanan mo yan.
3. Hindi kailangan ng Legal department sa kaso na ito dahil kahit wala sila ay pwedeng mai-close and kaso.
4. Baka Frustrated Theft ang nangyari. Kahit walang nawala ay pwedeng ikaso ang Theft sa isang tao.
5. Theft is a grave offense against another person or entity. Ang perfume ay isang personal property ng isang tao at hindi sangkot ang kumpanya dun na obligadong pakialaman ng kumpanya. Kaya hindi kailangan ng intervention ng legal department sa kasong ito.

1. wala pong nawala kasi mismong ang accuser ang nagsabing nasa bag nya ang pabango
sa cctv nakita na almost 6 seconds ko lang hawak ang bag kasi katabi ko ang accuser, nung may inaayos ako sa likod ng pedestal ko nasagi ang nag nahulog and dahil dko alam n may nawawala na sya kinuha ko un and isinabit - so paanong in 6 seconds nabuksan agad and nakuha ang item? ni hindi nakita s cam na may ginalaw ako sa bag-hawak ko lang

I suppose ni-raise mo yang mga bagay na yan nung hearing? If not e final and executory na yang decision laban sayo. Baka napirmahan mo pa yang Sanction Memo ng termination mo. If so, it's as if sinasang ayunan mo mga detalye na nakalagay doon.

Yun ang hindi mo na mababago. Pinirmahan mo yung Sanction Memo, then lahat ng mga salita at detalye doon, mali man o tama, ay sinasangayunan mo. Ibig sabihin, sumasangayaon ka na may nangyaring pagnanakaw at iklaw ay napatunayang nagnakaw at ikaw ay na-terminate dahil sa pagnanakaw.

Hindi din. Basta may sapat na ebidensya laban sa empleyado, kahit ayaw niya pirmahan ito, pwede pa rin siyang tanggalin.

past 5pm n ako kinausap ng HR and before signing i am also asking for the copy of video para if i will appeal magamit ko, ung HR pinasign muna ako.

ung accusation ng theft ang gusto kong ilaban, malinis man lang name ko.

breach of trust and theft ang kaso - wala pong nawala, ung accuser ang nagrequest sa HR na i view ang cctv dahil may nawawala daw sa kanya. one of the IT man went to our area para i check ung bag, andun naman ang perfume. though nakita sa cam na hinawakan ko ang bag. reason is - we ate seatmates and nung may inaayos ako sa likod ng pedestal ko nasagi ang bag and nahulog so ako naman kinuha ko ito para isabit ulit s lalagyan. ilang beses naming pinaulit ulit ang scene na un, 6 seconds, ni hindi nakitang binuksan ko ito, ang bag ay may zipper, and sabi ng accuser naka box ang perfume and medyo malaki. un ang kino contest ko. kita naman na wala akong kinuha. sa paghawak ba ng gamit pwd ka ng pagbintangan? and dun sa complaint nakalagay na andun ang perfume

for so many times tinanong ko ang hearing panel kung may magpapatunay na mayroon nga bang nawala e andun ang perfume. tinanong ko din sila na kapag ba may nagreklamo pwd ng i consider agad na valid ang complaint?

wala po silang sinagot sa mga tanong ko, i even dared HR na ipakita sa operation employees ang video and ang decision nila para i check if may maniniwalang kaya kong magnakaw - pabango pa?

kinausap ko ung nawalan and she's insisting na may nawala and paano daw bumalik? malinis po ang conscience ko. i even requested for lie detector test - wala silang sagot

sir, dko po control if the reason is "breach of trust" pero and sabihing may theft iba na po yun. 6 yrs po ako s company with good records, am awarded as employee of the year, had pending promotion as manager, para lang ma accused ng ganito.

and yun pong 1 of the hearing panel is our operation manager, both accuser and i wer under her. aftr nga ng hearing i felt na unti unti syang lumalayo sa akin.
when i talked to her to ask if i can resign kc dko na ma feel that i belonged to the department, marami syang sinabing issues about me, na ako lang dw ang nag iisip ng ganun but even our co workers knew na pinapahirapan na ako. pati postings ko sa fb binanggit nya samantalang wala naman akong sinasabing pangalan or scenario about my case

kung may cctv, makikita don nung ma discover nung officemate mo na nawala yung perfume, then makikita din don kung sino talaga kumuha at sino nagbalik.. dapat pina review mo yung cctv na kaharap ka..

ni review pero ang pinakita lang ung night before while i was working ... and ung next day wherein na nakita nga na hawak ko ung bag. sabi wala naman daw importante in between thise times. kung ako and ung seatmate ko lang ang nakitang gumagalaw dun sa area, does it mean na ako na kumuha? sabi ko nga po nung nakita s cam n hawak ko ung bag its only 6secs, ni hindi ko binuksan. and ung question ko sa HR na sure ba silang may pabango dun na nawala and bumalik - na hindi po nasagot

i applied for an nbi clearance and got a hit and must return 5 days after. natatakot lang ako kasi i saw some reasons of nbi hit ... i had a HSBC loan last 2005 with issued PDC, unfortunately i didnt paid it fully coz na demolished ang bahay namin, lost my job and my mom died. since then on d na rin ako nag loan or kumuha ng credit card. now my worry is: can it be the reason why na HIT ako ngayon sa NBI? need ko pa naman clearance in applying for a job. hope you can help me, am so nervous ... actually aftr 2005 lumipat kami ng bahay and nakabalik lang kami sa dati naming lugar last 2012. nawala na rin lahat ng records ko ng loan and payment ...

Hi,
I'm a call center agent.
I need your advice. I was tagged at work RTWN (Return to work Notice) due to My absences but My supervisor didn't let me know of My status. I just know it with my colleagues a week from the day I was tagged, since ako ang nag ask sa kanila if kumusta na tagging ko. Wlang araw na pumalya ako sa pag cacall in pra hindi ako Ma no call no show
and now I ask my colleagues to check my Locker and they told me it's cleared already. But before that I signed a Notice of Decision for final written warning for my absences and I will be terminated. My problem is will I pay for a breach contract? Or I will be terminated? Can I still get my Last pay? Will I still receive a COE?

It would be better to know that is in your contract, however, in general:

pay for breach of contract - yes if you are separated from the company and there is a clause in your contract that you need to pay a certain amount if you did not stay in the company for a certain number of years

will I be terminated - don't know, the info you stated is too limited

can I get my last pay - depends if you have monetary liability.

will I still receive a CoE - yes
