Demand for termination or force resignation?

Good day po,

Just raise up my concern po .. I am a regular employee of our company and I serve them for 3 years , marami na po ako naging memo which I have received a penalized done naman po minor case naman po, this year they give me 3 memo and a preventive suspension for 1 month, gaya po ng ginawa nila sa ibang kasamahan q pinag force resignation n lng sila ..instead of termination .. Pumayag cla kc natatakot cla.. Question po .. On our next hearing po at pinilit po aq mag force resignation may karapatan po b ako tumanggi or mag demand na lng n termination instead? Please advice po thanks po ?

yes, hindi ka nila pwedeng pilitin mag resign. Mas pangit lang kasi sa record mo if terminated ka. Pag na terminate ka at dinaan sa tamang proceso, wala kang makukuhang separation pay

My basehan po ba for termination ? Anu pong dapat q gawin wat if kung hindi tlga aq pipirma for resignation ? For sure terminate nila aq at bakit wala po aq makukuha separation pay if they terminate me ? Thanks po

kasi yan ang nasa batas, if may just cause ang termination no need to pay separation pay. Based on what you mentioned na you were under preventive suspension i suspect the hearing will find you liable for whatever charges iniharap sayo

So I'll just take the force resignation n lng po? Or resign PRA maging maayoss na lng po abg exit po kung wala naman po aq laban .. If mg resign po aq since I'm regular my makukuha pa po ba aq? Mababayaran p po b ang mga leaves q? And 13th month pay? Thanks po

It depends on you. I would guess medyo serious ang infraction at na preventive suspension ka but i dont know the details.
Ang leaves and 13th month ay dapat makuha mo kahit nag resign ka or na terminated. If may makukuha ka aside from your salary, leaves 13th month etc, you should ask your employer kasi hindi sila obligado magbigay but parang pa consuelo lang.

pag nag resign ka wala kang makukuha, last pay, leave credits at pro-rated 13th month pay lang..

pag na terminate ka for a just cause, ganon din makukuha mo.. yung COE mo nakalagay terminated.. pero you can always contest it sa NLRC..
