Goodday Atty!

Presently po nasa ibang bansa ako and kakaumpisa ko lang po magwork. I left our hometown to seek for a higher salary. Unfortunately, marami po ako naiwang utang at lahat naman po sila ay kinakausap ko thru my cousin na pag nakarecover na ako uunti untiin ko pagbabayad. Lagi naman po kami nakikuliusap

Pero lagi nila sinasabing isasampa daw nila ng kaso. Some of them ay lending and others are personal na kakilala lang. May mga issued cheques din po ako but sad to say nagclosed na po ang account ko dahil nga po lack of funds.

Ano po ba ang pwede ko gawin kasi hindi din po ako matatahimik. Pwede po ba maging grounds yon para mapauwi ako ng Pinas?

Di ka nila mapapauwi, since a collection case for unpaid debts is civil in nature and the jurisdiction for such a case lies only within the Philippines.

However, it is wise to settle these debts ASAP since they may ask for damages if their case will prosper once you return to the PH. Is there an interest rate agreed upon dun sa mga utang mo sa kanila? May contact pala to begin with regarding on how you should pay your debt with them?

Exercise caution as well and only have people you absolutely trust handle your money. They may use your money for other purposes rather than paying your debts. There are many posts here with that problem, kaya ingat ka sa ganyan...

Kung hirap ka talaga sa pagbabayad, ask your relative to seek the help of a lawyer para magkaroon kayo ng better paying scheme para sa mga utang mo na hindi ka naman sobrang mahihirapan. Let the lawyer draft an agreement na conscionable sa iyo and sa mga pinag-utangan that contains a flexible payment scheme with an acceptable interest rate din.

sobrang takot ko na po dahil sa mga demand ng banko sa unpaid bills ko. nadukutan po ako at malaking halaga din ang nawala sa akin. hindi ko na kayang irecover pa yung mga nawalang fund kya nahirapan na po akong makapag update ng payments. wala na po talaga akong makuhaan ng fund ditto sa work. ano po ba ang dapat kong gawin? solo parent po ako at magulo na ang isip ko. sana po ay matulungan nyo ako.

That is unfortunate, and I am saddened with what happened to you.

Report what happened to you in the nearest police station to get a police report. That will serve as evidence of the robbery that occurred so that when you go to the bank, you can renegotiate the terms and conditions of the payment of your debt in consonance with your current financial situation.

If you fear that you might get imprisoned for non-payment of debt, that will never happen since a collection case for sum of money is a civil case, and only criminal cases have that element of imprisonment by the authorities.

Just to be safe, please go to the nearest Public Attorney's Office (PAO) to get free legal advice regarding your situation.

Actually ive been trying to contact them since October via sending emails and made an arrangment for the payment. Others replied but others not. Others replied that they are already filed the case under BP22. Kahit po ba may emails ako sa kanila for the arrangement they can atill sue me?

I am very much eager to settle everything atty. pero kung ayaw nila sa arrangement ko?

They even go to our house to the point na natatakot nila ang anak ko.

Sana po atty matulungan mo po ako what else can i do.

Good afternoon po. Mag tatanong lang po sana. Last September 2016 ay nagfile po ako ng personal loan sa Hong Kong kung saan ako nagtatrabaho bilang kasambahay, sa natanggap ko pong loan ay may ka~share ako na ang kinuha nya ay $5,000. Oct and Nov ay ok pa naman po ang pagbabayad nya sa akin but Dec po ay hindi na siya nakabayad kaya ini advise ako ng Lending Company na i~file na lang ng re~loan na siya ngang ginawa ko. At nakatanggap pa ako ng karagdagang amount. But sadly, an incident happened which made me resigned from my job in HK and since i dont want to go back in the Phils. unemployed, I did look for another job in other country and a job i landed. Ngayon po, 3 months ko ng di nababayaran ang loan ko at hindi na din po nagparamdam ang ka~share ko sa loan. Then, i received a text message from the Lending company na nagsasabing i~issue na or dadalhin na next week sa bahay ng employer ko sa HK at sa home address ko sa Pilipinas ang aking warrant of arrest for estafa (both civil and criminal) and warrant of seizure to sheriff and garnish property, possible po ba ito kahit wala ako sa Pilipinas? Pwede po ba nila i~file sa HK at Pilipinas ang kaso kahit wala ako dun? At ano po ang maaaring mangyari sa akin pag naisampa po ang estafa case, both civil and criminal? Sana po ay masagot ninyo, salamat po.

Hello po, I have similar prolem po with doctor Cash. I wanted to loan 2000 pesos po. They said 10% ang processing fee. So ang nabigay po sakin na Cash is 1800 nalang po. And in 10 days ko lang po gustong bayaran. Tapos and total po na sinisingil nila sakin is 2460 po. Talagang na sopresa po aq. First time ko kasi mag loan. Tapos nabigay na po sakin at nagamit ko na po. Hindi ko po nabayaran kaagad kasi nga naosbrahan lang po aq sa interest rate po. Tapos txt cla ng txt sakin at sinisingil po aq ng 3650. Tapos yong pinahiram lang po naman nila is 1800 lang po. Gusto ko pong e settle po yong na loan ko pero hindi ko po ako sangayon sa interest na binigay nila po. Tulong naman po.
