I would like to seek legal advice on a problem we have with a lending company. About 9 years ago, my mother made a transaction with a lending company with our land title as the collateral. The amount was about 20,000 PHP. She tried to keep it a secret until recently we found out about it. We went to their office and we were informed to pay 10,000 PHP monthly and it has to be consistent for them to reconsider. The company did not provide a time frame of until when are we suppose to pay for that amount. Moreover, this amount is only for payment of the interest. The principal amount went up to 1M.
There are few things I want to understand.
1. If we are unable to pay, does the company have the right to demand us to leave the property?
2. Is it legal for the credit amount to go up to 1M if the initial credit was only 20,000?
3. Can we settle with a lower amount to get our land title back?
