Good day!

Need advise lang po.

Sept 2010 - may utang father ko na P500,000 sa GSIS sa consoloan
Nov 2010 - Nag early retirement sya at the age of 54.

so may naiwan syang loan.
ang kinuha nya na retirement benefit is yung RA8291 na:
1. cash payment (CP) of 18months of basic monthly pension, payable at the time of resignation/separation
2. old age monthly pension at the age of 60.

Jan 2012 - nag file sya ng retirement sa GSIS

ngayong 60years old na sya, ang file sya ng pension sa GSIS. nagulat sya na ang laki ng utang nya.

kasi yung 500K na utang, may 12% interest per annum tapos yung 18months cash payment (CP) nya na 450K is naibawas lang nung Jan 2012.

so ang nangyari

Nov 2010 to Dec 2011 - 500K principal plus 100K na interest = 600K
Jan 2012 - dun pa lang naibawas yung 450K kaya may utang pa sya na 150K.

Question:

1.per RA8291, may prescriptive period na 4 years for filing ng cash payment. so kung 2012 nagfile father ko, pasok pa sya sa 4 years. so meaning po ba nun pasok  din sya dun sa term na "payable at the time of resignation/separation"? meaning dapat ba na yung 450K is ilagay sa schedule na nasa nov 2010 tapos ibawas sa 500K bago tumakbo yung interest?

kasi ang ginawa ng GSIS is yung 450K is binawas sa total outstanding loan nung Jan 2012 na lumaki ng 100K dahil sa interest.

per GSIS:
Principal +    Interets  =  Bal  -    CP   =   outstanding
500K      + 100K =       600K      - 450      = 150K

per my computation:
Principal  -   CP   =     balance  + new interest  =   new outstanding
500K      -  450K =    50K        +       20K                     = 70K

Buti nga po at siningil lang kayo ng GSIS sa utang niyo at di kayo dinemanda ng fraud. dahil yun situation na ginawa ng tatay mo can be used against him dahil mapapalabas nila na pre meditated ang pag utang niya at pag retire at the same time. be thankful dahil naging civil pa ang gsis sa inyo at di kayo kinasuhan at di nawala pension ng tatay mo kaya bayaran niyo nalang saka may terms and condition na pinipirmahan ang tatay mo kaya vaild yun interest at pag singil nila regardless pa yun sa situation niya dahil retired na siya.
