early retirement

may i just ask if there is such thing as early retirement for employees who reached 5 years of service...wala naman smen offer but i just want to ask if mandated by law na meron kme makukuha..thanks

only if you're age 65 and above.

My father had an early voluntary retirement at the age of 58. Nakuha nya po lahat ng benefits and Pensions.
I'm not sure of any early retirement after 5 years of service( 5 years palang retirement na kaagad parang ang bata pa yata nun ).

The compulsory age of retirement is at 65 while optional retirement may start at age 60. This does not prevent the company and its employees, however, from entering into contracts or agreements such as a CBA or employment agreement with early retirement provisions below the minimum ages set by law.

But for an early retirement plan to be legally defensible, the employees must have freely or voluntarily consented to the early retirement provision; otherwise, the early retirement may be considered invalid later in court as a form of illegal dismissal.

only if the company has a policy on that.. otherwise.. kahit 20 years ka pa sa company.. and wala ka pa sa retirement age.. wala kang makukuha..
