Hi,

I hope you can help us, we're currently working as customer service reps in a bpo company. The account /program we had was dissolved for some reason without discussing to us why it got dissolved. We have been on the account for over a year before it was dissolved. We're not given any notice in writing prior to the dissolution of account, we were moved to a different account eventually and underwent training then we suddenly have a talk with our manager telling us that we did not pass because of being not able to hit metrics required of the account. The head of the account told us that and we have to be moved to some of other account that the company has. He said we to prepare our resume/CV for an interview to be conducted by the assessor of the said account that we are profiled or moved to.

Note: that we did not even have to opportunity to talk to our HR since our hr is situated in other province.

I have these couple of questions given the situation above.
1. Does the company has violation of the labor law of the phillipines?
2. Can we demand for separation pay? Or are we entitled for separation pay if they violated the labor law?
3. If there are violations committed by our employer can you enumerate those?

We just had our discussion today and we're informed that we have to wait for the training schedule. They said that we will be on "floating" status until we start our training. They said that while in floating status we are not going to be paid.

My question is, is it fair on our part since our source of income to sustain our needs is our salary?

yes employer can put you in floating status without pay up to 6 months. after six months they either have to hire you back or pay you separation pay
