is it right / legal for a company to ask an applicant to sign a form for a background check even if the applicant is still not hired?.. isn't it it is normally done after getting hired?

I see no reason as well that can make such a prerequisite by an employer for his prospective employees illegal and malicious.

An employer has all the right to properly screen potential employees and have his own standards that should be met accordingly, as long as it is not unduly oppressive and discriminatory.
