BACKGROUND CHECK AFTER YOUR EMPLOYMENT

Hi!

I would just like to consult if it is legal for your previous company to conduct a background check to your current or future company after your employment with them? I just feel like it is somehow breaching your privacy since they should have conducted the background check BEFORE they offer you a contract.

Can I file a complaint against my previous employer for conducting a background check on me after my employment with them?

ah talaga? what if ilabas nila yung details na yun and gamitin laban sayo? ganito po kasi yung buong story.

illegal dismissal po ako kay PREVIOUS employer. nagsampa ako ng kaso sa NLRC. nagsubmit na kami ng position paper. sa position paper nila, nilagay nila dun ung background check nila sa akin dun sa NEXT company na pinasukan ko after nila. And what's more interesting is dinoktor nila yung nilagay nila dun kasi nakausap ko yung mismong boss ko dun sa company at sinabi niyang hindi ginamit ni PREVIOUS employer yung totoong identity nila at gumamit ng ibang pangalan na company. Nilagay din nila sa background check kuno na AWOL daw ako kahit hindi naman.
