Good day Atty!

Meron po ba ganto sa batas natin?

Ang mga lot po ay "of same value and area" since nasa isa isang lugar lang sila, but separated by a street. Magkatapat lang po ang properties.

Sa Property 1 po kasi ay paghahatian ng magkakapatid, at ganun din po sa Property 2.

To protect the current structures sa mga properties na yun, pwede po ba ang land exchange agreement? Meaning, hindi na kukuha sa property 1 si owner no.2 at ganun din si owner no.1 hindi na kukuha sa property no.2. Parang swapping po ang mangyayari.

there is no specific law regarding this, but it will be considered that both properties were sold and each will be liable to pay separate taxes.

so ibig sabihin po mag eexecute ng deed of sale? pano po kaya yun, wala naman magiging money involved sa transaction na mangyayari?

it can be a deed of exchange or separate deeds of sale. but the tax rule here is that it will be considered two separate incidents of transfer each requiring, capital gains, doc stamp and transfer tax.
