I'm in the process of helping my mom get the necessary information together to go after my dad who left her with nothing.

Dad emptied all their bank accounts from another country and moved back to Philippines to be with his mistress. Who happens to be my mom's sister in law (her husband/mom's brother passed a few years ago).

In the Philippines, everything is under my dad's name. Title's to lands, bank account in his name, car in his name, etc. We think this has been going on for years as this was all a pre-determined move having everything changed to his name. I'm assuming she's entitled to half the assets even though they are under his name? If she went to the municipal, does she have access to the titles of the lands showing proof that they're legally married? Bank account, etc? Thank you for the help.

Get MC from NSO as proof of marriage.

If mother is the legal wife in Philippines then I think she has all rights of a legal spouse including rights on conjugal properties as long as she can prove this in Phil. court and marriage has no defect and valid.

She has rights for spousal support. She may file RA9262 cases and/or concubinage case against husband as long as she can prove this in court.

You are also entitled for financial support from your father.

Seek legal advise from atty.
