Hello Good Day po.

Ang tanong ko po ay para po sa aking may bahay. Tanong lang po ako tungkol sa lupa na nabili ng byenan ko sa isang kakilala sa GSIS mga 25 + years ago na. Patay na po pareho ang aking mga byenan at naiwan na hindi naayos ng mabuti ang lupa sa GSIS sa dahilang naka pangalan parin ito sa dating may ari. pero meron silang pinirmahang mga documento na nag papatunay na binenta ang lupa sa byenan ko.

Dinala namin ito sa GSIS at sa tulong ng documento naming hawak, nabayaran po namin ang lupa pero di mapa sa amin ang titulo dahil ang sabi ng GSIS kailangan naming makakuha ng panibagong kasulatan sa dating may ari ng lupa dahil patay naraw po ang mga byenan ko ( hindi namin alam kung saan na ito sila hahanapin pa sa dahilang hindi rin nakita ito ng aking asawa ). Ang sabi sa amin sa GSIS, pwede daw naming makuha ang titulo ng lupa dahil nabayaran na namin ito pero sa pangalan parin ng dating may ari at kami nalang daw ang bahala mag palipat sa aming pangalan.

tanong ko po sana kung meron po bang ibang legal na paraan na pwedeng gawin para mailipat na sa aming pangalan ang titulo, tutal may pinirmahan namang kasulatan ang dating may ari na nag papatunay na binenta nya ang lupa sa byenan ko at hawak napo namin ang official receipt ng GSIS na nag papatunay na kami ang nag bayad ng lupa. Pwede po bang gamitin ang lumang documento na pirmado ng dating may ari na nag papatunay na binenta na nya ang lupa sa byenan ko para mailipat na sa amin ang titulo ng lupa. Isang dahilan pa po ay hindi na namin mahanap ang dating may ari ng lupa, di narin namin alam kung patay narin po ito sa dahilang matagal na panahon narin ang lumipas.

I'm not Filipino, I don't know what GSIS is, so perhaps my answer is stupid Smile
or perhaps you can have use of it.

Is it Titled or "Rights" ?
If "Rights", and your family have paid tax for it at least 10 years, then you have chance to GET the title by applying to Land Registration Authority (LRA) and pay a fee. (I don't know how big fee, but a teacher could afford to pay for 8 such for all the family properties, so I suppouse not huge fee.)
(Register of Deeds have similar but then it's for properties in same family since close after WWII.)

If Titled allready, you can TRY asking them if you can use that law anyway and add the documents you have.

hi lunkan,
just an add up info about gsis for park2016 , gsis is a social insurance institution thats managing the housing loans for the philippines government employees.if you're in a public service like teachers, police etc.you can take up a housing loan via gsis, but if you're in private sector,its sss and pagibig.

I see.
Pag-Ibig is very unfair (if it isn't changed). The fees TO Pag-Ibig is OBLIGATORIC,
but they give loans to only URBAN properties, NOT to Rural !!!

Sorry I can only litle about Property laws (I read mainly Business and Tax laws). Plus my Tagalog is terrible Smile so I don't understand if you told if it's "Rights" or Titled. in some situations it's a big difference, that's why I asked.
