i need legal advise,my husband is working in canada,were seperated more than 3 years.he's not supporting our child.we have 2 children.the eldest is with his family and the youngest is with me.im working to sustain our needs.i emailed him to get financial support and he dont like to give it.he said he already filed an annulment in canada and even if i did not received the letter and not sign it,it can be processed.he said we have split custody .we will not receive anything from him coz were not his obligation anymore.he is living with other girl there,the same girl that cause our seperation.and the girl is pregnant now.what will be my first step

unfortunately, philippine law cannot be enforced in canadian territory. the most i can think for you to do is to file a case of economic abuse under ra 9262 here, and if it prospers, have the warrant of arrest implemented if he comes back.

naguguluhan po ako.kailangan ko po kasi ay suporta lang sa bata at makuha din ung panganay sa kanila dhil magulang lang din nya ang nagaalaga.at gusto ko rin malaman ung annulment na sinasabi nya sa akin.posible ba na maprocess kahit na nasa canada sya at di ako pumirma dahil wala naman akong natanggap na sulat.

i cannot speak for canadian law, but if he is still a filipino citizen, then that divorce will not be recognized here. some states allow for no-fault divorce and the presence or signature of the spouse is not required.

you can file a petition to acquire support and custody of your child here, but even if granted, i do not know how it can be enforced outside philippine territory.

filipino citizen pa rin po sya.ung kinakasama nya ung may mga kamag anak dun kaya sila nandunb.nagaaply p lang po yata ung babae ng residency doon.ang sinasabi ng asawa ko annuklment daw ung pinadala nya.pano po magfile ng child support at custody?

a petition is filed in the family court where you reside. note, even if your petition is granted it will be virtually impossible for you to have the court's order enforced in canada.

if it was a divorce decree and he is a filipino, then it is void.
