Hi. I would like to consult about my contract regarding my regularization. In my contract it is said that my training is for 1 year and the first 6 months is under probationary period and if I passed that period the company will confirm my employment status as regular or permanent. But then the company told me that I am not regular after passing the probationary period and my regularization will be after 1 year. But then its weird that in the contract they said after 6 months of training now what they say is different. Do I have a say to this? Because my contract has a training bond and I don't want to pay them for breaching my contract.

If you fail your probationary period, the company may extend it (as needed) to further assess your performance.

How is it that they say you are not regular?

Did they give you a document showing that you did not pass the 6 month proby period?

Well first of all in the contract it is said I am entitled to a 5 day leave (for regular it is 15 sick leave and 15 vaction leave) but my boss said since I am not yet regular I still don't have leaves. Second I passed the probationary period but they are still telling me that I am not regular and so no increase in salary or whatsoever.

The thing is that what they say is different from what is written in the contract. Which is supposedly I should be regular now with 15 sick leave and 15 vacation leave and salary increase. But they say I am not yet regular and I am not yet entitled with leaves.

Good day i want some advice regarding on my regularization. I am from cebu ,i am an accounting staff from a manufacturing company. I was started on June 2013,as what the admin says that six months for contractual period and another six months for probationary period. Because that was the rule for the company I obey them.  After one year in service, its June 2014 when I receive the performance appraisal evaluation for regularization. But few months after I receive again another performance evaluations because I cannot pass the performance appraisal because of my late few months before I receive the first PA evaluation , I receive the second appraisal November 29 2014. And I send it back by December 4 2014. And until now I wont get any feedback from them. When I ask the admin she told me that the admin  main office in Manila did not receive my appraisal. And according to my immediate head in Cebu that he pass it already . And now I heard a rumor that my appraisal was lost.

So this is my questions poh.,.
1. Is there any disclaimer to the labor law that the company wil evaluate the employee after 1year for regularization?

2. Is it normal for the delay of sending the performance appraisal at the second time after i may not pass the first one?i send the first one by june and receive the result by november together with the 2nd evaluation form.

3. Maraming months napo ang delay,.ano po dapat gagawin nito?
4. May dapat bang panagutan ang employer dito?kasi sayang yong benifits ko .,,
5. Ano po ang mga posibilies na mangyayari sa case nato?
6.pag magreklamo ako sa labor matatanggal vah ako?

Case ko naman po 3months probi then after nun 6month contract as project base after my 6months meron silang pinapirmahan na 1yr fix term na kung saan after daw ng 1yr fixterm e magiging regular employee daw po nila ako, studio cameraman po ako direct hired ang tanong ko po tama po ba ung mga pinirmahan ko ok lang po ba sya thank you po sa sasagot

Badly needed help po.
I have been in this company for almost 2 years na.
I applied to work as Company Nurse, I am a LICENSED RN. (QUESTION 1: DO THEY PAY FOR LICENSE ALLOWANCE FOR MY POSITION OR IT IS ONLY APPLICABLE TO LICENSED ENGINEERS??)

On the said date I started to work as COMPANY NURSE / HR ASSISTANT. I really have no background on HR matters so the HR Supervisor told me I will train for two weeks with an apprentice rate of P236.25 (Is that professionally and legally accepted on my part??) I had no further questions because it was my first job in the industrial set-up. I worked as a trainee in the largest mental heath facility before I got the job. I did not signed any contracts and I was really not formally trained. I learned through first hand experiences. So I really had no idea on how much work load is too much. But working as a NURSE and at the same time an HR STAFF, aside from the MEDICAL SITUATIONS I handle every day, I also do the hiring, recruitment, orientation, time keeping, payroll, benefits etc., that I have learned should be assigned per sub-departments of the HRD of the company. We are only 2 on our department, me as the COMPANY NURSE AND HR ASSISTANT & and my HR Supervisor. So all the workloads are on us.

After the said training, they paid me MINIMUM WAGE, P315. 5 months later my supervisor told me that I am doing my job really well, based on the performance evaluation she has made. She told me that they did not have a slot yet for regularization so I have to wait and for the mean time I will be under CONTRACTUAL FOR 1 YEAR. Until the months passed by and I encountered a problem in my work when I was already 1 year and 4/5 months in the company and they used it so that my so called PROBATIONARY will be terminated, though my HR Supervisor insisted on keeping me due to my performance and skills. I have learned that MY POSITION AS COMPANY NURSE, AS A PROFESSIONAL, IS IMPORTANT IN THE COMPANY THOUGH MY SUPERVISOR INSISTED THAT THE MANAGEMENT SEES MY PROFESSION EASY TO BE REPLACED, WHICH FELT AS AN INSULT TO ME AND MY PROFESSION. NO SALARY INCREASE, SIL ETC. NOW I AM PREGNANT AND STILL WORKS HERE BUT I TRIED CLARIFYING THAT I SHOULD BE A REGULAR EMPLOYEE AS EARLY AS DECEMBER LAST YEAR (11 MONTHS FROM WORKING IN THE COMPANY). MY SUPERVISOR TOLD ME THAT THE 1 YEAR CONTRACT EMPLOYMENT WA BASED ON DO 18, IS THAT TRUE? BECAUSE UPON READING IT, IT DID NOT STATE ANY CONTRACTUALIZATION FOR 1 YEAR???


IS THERE SUCH A THING AS 1 YEAR CONTRACTUALIZATION? IS IT BASED ON DO 18? AND IS IT APPLICABLE TO PROFESSIONALS LIKE ME?

WHAT ARE MY STANDS? WHAT RIGHTS DID THEY VIOLATE? WHAT CAN I APPEAL?

ARE THEY LIABLE?

IN ADDITION, MY SUPERVISOR TOLD ME AND WARNED ME THAT THE OWNER HAS GREAT CONNECTIONS TO DOLE AND ALL THEY WILL DO IS PAY FOR IT. SO IT IS USELESS TO RAISE ANYTHING TO DOLE. IS THAT FAIR?
