magandang gabi po... tatanong ko lang sana ang case ko kasi gusto ko makuha ang custody ng anak ko sa nanay nya... di kami kasal at hiwalay na kami ng ilang taon.. pinatulan ng nanay ng anak ko ang bayaw ko na di din kasal sa kapatid ko... nagsasama na sila ng bayaw ko ngayon at meron ng mga anak... gusto ko sanang mag file sa korte ng child custody pagbalik ko ng pilipinas dahil nasa abroad ako ngayon... matagal ko ng di sinusuportahan ang anak ko dahil sa pineperahan lang naman ako ng nanay ng anak ko... may habol ba ako sa custody ng anak ko? pwede ko ba sya makuha sa nanay nya sa grounds ng immorality?... dahil sa pagpatol nya sa bayaw ko at pagkakaroon nila ng mga anak?... pwede ko ba ilaban na mas may kakayahan ako magsuporta at bumuhay sa anak ko dahil may ipon ako sa bangko para sa anak ko?.... hindi kami kasal pero nakapirma ako sa birth certificate at di din kasal ang kapatid ko sa bayaw ko pero di din nakapirma ang bayaw ko sa birth certificate ng pamangkin ko kaya unknown father ang pamangkin ko

Award of custody of children depends on the age of the child. If below 7, it is always the mother, unless the court find compelling reasons. 7 years above, childs decision is given weight by the court.

If the child really is neglected and abused, you can go to the DSWD and report the incident so that the child welfare would improved. Your last resort would be adoption of your child, that is, if the DSWD found probable cause to get the child from the mother
