Custody of My Illegitimate Child

I have a 6 yrs old illegitimate child i left the child for 5 yrs to his biological father because i went to abroad for work.Still im in touch wd my son through calls and chats and im sending his needs through cargo.And everytime i came home for vacation im with him.

Now i came back and i want the custody of my child but his father didnt agree and he was fighting with me sending me sms which is hostile insulting me.

Please advice me what i will do to get my son what are the steps that i need to do.Right now i decided not to go back abroad because i want to settle these problem first so i was unemployed for 5 months.Is these a ground that i cant get my son?

parental authority and custody over an illegit child is vested solely on the mother, but you have to be here to exercise your right.

to get custody, i recommend you first file a complaint at the local dswd office and they may call a conference.

but even if you get custody, if you leave again, the father will have the right to get back the child.
