Meron pong property ang lola namin sa dumaguete city.

12 years old sya ng pumunta ng manila so this nov. 21 lang sya nakabalik ulit dahil di naman kami mayaman at ngaun lang naging maalwan ang buhay namin. May pagka bingi at malabo na ang mata ng nanay ko. Pinapirma sya ng deed of absolute sale at iginigiit ng abogado na illigitimate sya at walang karapatan. grade 6 lang natapos ng lola ko at pumirma sya dahil sa ipinaliwanag ng abodgado at eto pa 20,000 pesos sa 69.7 sqm na lupa sa dumaguete city.

Ano po ang dapat namin gawin.

when was this sale? her remedy is to file a case for rescission of the sale, but it will be tough going if it has been a long time.

Nov 24 lang po ang deed of sale ano po ba ang pede namin ihabol kasi cost pa lang po ng sale parang cp lang ang binenta at ung nagpapirma sa kanila na atty. pinagdiinan na illigitimate ang lola ko at walang karapatan di po nun naiintindihan ang legal doc na ganun kaya ayun napapirma sya

lola ko po ay nag iisang anak sa pagkadalag ng kanyang ina gusto lang po sana namin magtanong kung may habol po kami sa nangyari.

Nagpunta po ang lola ko sa Dumaguete noong Nov. 21, 2010 mula 12 y.o. sya di na sya nakabalik dun ng matagal na panahon at dahil po sa isa namin pinsan kaya sya nakarating dun. Ang aming hangarin lamang ay ang magbakasyon sya at nais nyang makita ang kamag anakan nya doon na nawalay sya sa di inaasahang pagkakataon pag uwi nya may Deed of Absolute Sale syang pinirmahan 69.7 sqm na lupa sa halagang 20k noong Nov. 24 nagulat kaming mga apo na may alam kahit papaano. Kaya daw po sya pumirma dahil ang sabi po ng abogado illigitimate daw sya at walang karapatan sa lupa. Di po nakapag aral ang lola ko at mahina din po ang pandinig nya may witness n nakapirma na anak nya di nya rin naiintindihan ang ganung bagay dahil lumaki sya sa manila di rin sya nakakaintindi ng bisaya. Sabi pa ho ng kamaganak namin na nagbigay ng pera pasalamat pa sya at binigyan ng pera dahil di naman sya nag alaga sa kanyang ina noong nagkasakit. Sa totoo mahirap ang buhay ng lola ko ngaun lang naging maalwan dahil sa aming mga apo na nagsumikap mag aral. Ang hangad naming bakasyon at kasiyahan ng aming lola ay nag iba pag uwi.

Ano po ba ang maganda namin gawin.

if you wish to question the deed of sale, then you will have to file a case to annul the document on the basis that there was lack of consent owing to that your grandmother did not understand what she was signing.

due to economic reason we decided to down sale the unit , meaning we change the unit for lower value , but unfortunately the developer charge to us the adjacement for the commission of other unit which is in higher in value , there reason is that they pay the commission in advance ,my question goes like this ,does the action of the developer towards commission adjacement is still within the boundaries of law?

there is no direct provision regarding this matter, but to my mind, it should not be considered a violation of your rights because it is true that developers pay for broker's commissions.

what i recommend to you is that the broker's commission for your new unit should be given to you as a discount, so your lose should only be the difference between the commission's of the big and small unit.
