refusal to accept resignation

i am asking this in behalf of a former co-employee. he submitted his resignation letter which was duly signed by his manager in september 2014. unfortunately, today (dec 4) he received a letter asking him to report for work on monday since his resignation has not been accepted. does the company have the right to refuse his resignation? he is already employed in a different company now.

Hindi pa ba sya nagpa-clearance?

what do you mean " duly signed by his employer" ang resignation letter of your former co-employee?

His resignation was "received" by the manager but he was told that it was not accepted.

hindi tinanggap 3 months later?

Did the resignation letter indicate his effective date of resignation?

Note: The Labor Code requires the employee to give an advance notice to the employer of his intention to resign. The notice of resignation must be in writing and must be served to the employer at least one month prior to the effective date of his resignation.

Kindly check your company policy if the manager who received and acknowledged the resignation letter itself is the last person who will approve the resignation. If not, then the resignation was not deemed acknowledged.

And yes, same question did he took an exit clearance? Usually, this is the last method for the resignation to become effective.

The resignation was received by the direct manager and it was given with the 30 days notice prior to effectivity. No clearance was signed. Unfortunately he was informed that the SVP for admin should have been the one to accept the resignation. It was forwarded to him by the manager and yes, it was only 3 months later that the SVP gave him notice that the resignation was not accepted. The compny knew that he already started work in another firm 2weeks after he left.

It turns out that he had a clearance signed by the Lab Manager, Comptroller/HR and EVP.  It is the SVP for Admina nd Finance who is holding back his resignation.

medyo same case po sa husband ko. nag-advance notice siya, 30 days which is the norm pero sabi nung boss  hindi yun tatanggapin dahil may darating na client in 30 days at need and full force ng operation. otherwise, 15 days na lang irender niya. Tama po ba yung ganun?

Pwede bang yung ereject ng HR yung resignation letter mo without any reason? Kahit na gusto mo nang magresign?

hi. ano po bang dapat kong gawin.. ung past employer ko po kasi nagpadala sakin ng letter from their atty. and and nakalagay dun sa letter na i have to pay 60,000 for the damage sa company nila. awol case po ako. nagfile po ako ng resignation pero di nila tinanggap. i have to leave my job na kasi magttrabaho asawa ko abroad and walang mapagiiwanan sa mga anak ko.. thank you..
