LOAN INTEREST 60% PER MONTH

Good day po sa lahat. Hoping masagot ang concerns ko.

Ang X mrs ko ay may existing loan sa isang microlending bank. 90K ata yun. umalis xa sa bansa noong July 2013 ata. Ngayon ako ang sinisingil ng naturang banko kasi nakapirma daw ako sa loan nya.

These are my concerns:

1. Am I liable to the loan of my X mrs?
2. Is it lawful that the bank imposes 60% per month on unpaid loan?
3. What can  you suggest on how to overcome this problem of mine?
4. Pwede bang ang X mrs ko nalang kanilang hahabulin instead na ako?

Note: Di talaga ako makabayad ng maayos kasi bago lang ako naaksidente. May mga utang rin ako na dapat ko e settle. Pumunta ang CI sa amin sabi nya kahit konti makabayad ako per month para daw di nila maipasa sa legal division for legal case. I am giving P300 depende sa pera ko maibigay. Ngayon sabi na nman ng CI lakihan ko raw.

I am quoting your questions below to properly address them:

1. Am I liable to the loan of my X mrs?

Since nakapirma ka sa loan, yes liable ka dun. Pero get a copy of the contract just so you can check kung ano yung extent ng liability mo.

2. Is it lawful that the bank imposes 60% per month on unpaid loan?

No, 60% monthly interest is unconscionable. But please check if it is really 60% sa contract.

3. What can you suggest on how to overcome this problem of mine?

Contact your ex wife. And have her settle her obligations to the bank.

4. Pwede bang ang X mrs ko nalang kanilang hahabulin instead na ako?

Yes, pero if hindi nila macontact or hindi sila maka-collect dun sa ex wife mo, ikaw talaga hahabulin nila kasi married kayo (?) and nakapirma ka sa loan.
