Hi. Good Day! I need your advice regarding what course of action should i take about BPI making unauthorized deductions from my payroll account with them. I have 2 accounts with BPI, a payroll account with my company and a personal savings account. They had a system glitch last October 12 which as they say caused the accounts to have not been debited or deducted even when we have already withdrawn. I dont keep any money on my payroll so I transferred 11k to my savings. i withdrew all of that by the 14th of October, come October 16 my savings account became negative 6000.00. I called them up and their supervisor told me about the system glitch and said that they will make it positive again. It never happened so I called again recently and they told me that I have overwithdrawn my account thus I owe that amount on my savings. I didnt agree with them coz I knew I havent overdrawn my account thus I didnt do anything. Come salary day which is today october 27, I saw my payroll account was only 2thousand plus. I called BPI and thay said that they deducted the 6000.00 to offset the negative balance on my other account. They also said that the financial directors of our company authorized them to do the debit. Now my question is, was it legal for them to do so? if they had the company's permission, can i file a money claim thru dole against my company coz i never authorised them to deduct anything from my pay? what should i do? i live from paycheck to paycheck and am the breadwinner of my family and for them to do this is inhumane. pls help. tnx in advance

first, do the accounting. what will your bank account state if you have it printed out (you can enroll on their online banking)? the question here is whether you really were deducted illegally.

then send a letter inquiry to your finance group whether the claim that they agreed to it is true. actually, if bpi is correct, their approval is not necessary.

you will have to send a demand letter to bpi. if they refuse, your remedy is to file a small claims case. i don't believe a complaint to dole is the best way to go about this.

thanks for your suggestion. i really haven't checked my statements yet, but are you saying that if i have overdrafted a personal savings account, its legit for bpi to take money from my payroll account that is also with bpi?

legally, a bank is not a keeper of your money; it loans the money from you. if you were overdrafted, then you also owed the bank. the bank then can deduct from its loan to you. the legal principle is called compensation.
