Hi,

Got question regarding termination

Is there a specific number of days before the effectivity of actual termination due to performance? Or is it valid to terminate immediately?

What if the employee files resignation, can he still be terminated?

It's valid to terminate immediately since there may be risk to the company or its clients if the employee stays longer than necessary.

If the employee files his resignation before the issuance of the termination letter, it is up to the management to decide if they want to accept it.

If the termination letter is served first, it is also up to management to decide if they want to accept the resignation letter.

termination is valid immediately but the company should have undergone due process by first giving the employee a written notice of his offense and five days to provide his response, a hearing if he contests the charges and another written notice if he is terminated.
