Hi po,

Tanong ko lang, currently kasi, I'm working as a Software Developer sa isang I.T outsourcing company. Pero contractual lang ako doon.
Ganito po kasi yung situation, may 1 year contract ako sa company ko, and then, inassign nila ako sa isa pang company para dun ako magwork as an external employee. Pero yung company kung saan ako naka assign ay nagretrenchment.
Ang tanong ko po:
1. Pwede bang hindi ituloy ng company ko yung 1 year contract ko sa kanila ng wala akong makukuha like separation pay?
2. Hindi ba dapat bayaran nila ako kasi nakapirma ako ng 1 year sa kanila eh.
3. Ano po bang habol ko sa ganitong situation?

Sana po matulungan nyo ako.

kung mawawalan ka man nang trabaho don sa assigned company mo babalik ka lang don sa tunay mong company kung saan may contract ka na 1 year.. bahala sila kung san ka nila i a assign ulit..

As far as I know kasi, yun lang yung client nila sa Pinas eh, yung iba is out of the country na.


Pwede ba nilang hindi ituloy yung contract dahil wala silang deployment na available? Anong habol ko kung ganun ang mangyari?

They might pay you separation pay, up to 1 month salary.

Pero ito na nga po, nangyari na ang di inaasahan. Kaka announce lang samen kahapon.
Yung 1 yr contract namen, hindi na matutuloy since nagbackout na yung client.
At wala daw kaming makukuha aside from 13th month pay na prorated.
Wala ba kameng habol? Di ba parang breach of contract yung ginawa nila? 1 yr contract namen sa kanila, pero hindi nila sinunod yun. The fact pa na may mga tinanggihan na din naman kaming offer dati because of them.

You may wish to consult with the nearest DOLE office to inquire about separation pay.

Depending on the reason of the downsize, you may be entitled to 1/2 to 1 month salary as separation pay, aside from the other mandatory benefits/payments.

wag mo nang pag aksayahan yan.. hanap ka na agad ibang work.. maximum you can get is 1 month salary as separation.. baka kulang pa yun pang gastos kung mag aasikaso ka sa DOLE or NLRC.
