Hi, I would just like to inquire on some technicalities stipulated in Article 281 of our Labor Code.

1 - The duration of the the probationary period, does it start on the day of employment and the 6th month would be on the 180th calendar day?

2 - In case they deemed not to regularize an employee, since he/she did not meet the standard the company imposed, does an employer reserves the right to serve the document of non-regularization on the 180th day of employment?

Your opinions and advise are highly appreciated.

1. Yes.

2. Generally on the 180th day, you are deemed regular. The employer may contest that regularization is on the 180th day but that's going to be tough to prove. So any termination is usually done at least 3 days before or somewhere along those lines.
