Hi Atty. Ask ko lang po sana, db po right ng solo parent ang FLEXI SCHEDULE? At kung ayaw po ng employer ibigay yang karapatang yan, di ba po dapat ay mayroon silang EXEMPTION galing sa DOLE?

Ganyan po kasi ang sitwasyon namin ngayon sa opisina. Ayaw po ibigay yung karapatan namin for flexi schedule eh wala naman po silang exemption from DOLE. Ang sabi pa po sa amin, wala daw exemption regarding flexi schedule na need sa dole, basta daw depende po sa company productivity yun kaya hindi maibibigay sa amin. Yung exemption daw po na nakasaan sa solo parent's act ay exemption kung hindi nila kikilalanin ang mga solo parents at kinikilala naman daw po nila kami.

Please help us po. Salamat

Where did you get that idea that solo parent are given right to have a flexi schedule? What the law mandates is that you must be given a 7-day solo parent leave on top of your SIL.

Section 6 po of Solo Parent's Act.

Section 6. Flexible Work Schedule. - The employer shall provide for a flexible working schedule for solo parents: Provided, That the same shall not affect individual and company productivity: Provided, further, That any employer may request exemption from the above requirements from the DOLE on certain meritorious grounds.

There's your answer.

What's your job, and what industry? Individual and company productivity is critical. So they already know that productivity may suffer if flexible work schedule is implemented.

It's like working in a 9-5 job (bank, etc) wherein there is no other shift so a flex time is not a possibility.

And the exemption is a "may" not a "must" so they might not be required to request for it.
