Final pay Inquiry

Sir, ang computation po ba ng final pay sa Call center industry is controlled by DOLE or may sarili silang format? 5 years po kasi ako nag work sa call center tapos nag-immediate resignation kasi pupunta ako ng ibang bansa. ang alam ko po, parang may penalty talaga kapag hindi nag bigay ng 30 day notice. Depende po ba sa company kung part ng final pay yung years of stay?

Pinadalhan ako thru email ng final pay status ko, nag-result siya as negative amount, pero wlang computation specially yung percentage ng penalty.
Nagkaroon p ako ng clawback which is the same amount as my basic salary.
Ganun po ba talaga sa mga call center?

No. Standard ang computation.

Kung walang retirement benefit ang company, walang kinalaman ang 5 years mo sa computation.

And if merong damages or penalty for non-compliance of the 30-day notice, pwede silang maghabol sa iyo either via DOLE or the courts or implement a clause sa contract mo regarding immediate resignation.

Post mo muna kaya ang computation na binigay sa iyo.

You may also need to post the clawback clause from your contract. So far it may be considered valid unless proven otherwise.
