Good Morning po,

Yong frend ko po kasi meron po sila maliit lang na retailing shop na ang nature is service and general mechandising lang po na less than 10 employee lang po. last october 2013, nagpaalam po ang isang trabahador po nila na pupunta sa namatay niyang kapatid sa province kasama ang iba pa nyang mga kapatid... napag-alaman po namin na hindi naman pala siya doon pumunta kundi sa iba na hindi namin alam kung saan (meron na pong deceit siyang ginawa). before po siya umalis, inadvance na po niya 13th month pay niya.december 2013 papadalhan po namin sana ng AWOL notice pero problem po is hindi po namin alam kung saan po namin papadala...yong trabahador po na yong ay gustong bumalik sa shop this february pero ayaw n ng frend ko tanggapin... meron po akong mga katanungan po sana :
1. obligado po ba frend ko papasukin uli ung nasabing trabahador? paano rin po incase not fit to work po siya
2. entitled po ba siya for separation pay incase
3. incase of worst scenario at nagkasuhan po sila, puwede po bang magfile ng case against the employee for damages cause by neglecting and abandonment of duties.

nakatanggap na po ng notice of conference yong frend ko at ang complain po are the following:

1. tinanggal daw po namin siya sa trabaho
2. claiming for separation pay.

1. ano pong approach ang puede po naming gawin para madismiss ang complain?
puwede po kaming magpresent ng affidavits ng mga witnesses? plus unserved AWOL notice? (hindi po namin alam kasi kung nasaan siya during his AWOL)
