13th Month pay

Good Day!

Ask ko lang kc we started on our company as minimum wage earner (php456) from February to July then from August onwards our per day rate is php560.90 but this is not reflected on our contract. Tanong ko lang, dapat bang pro rated parin ang aming 13th month kahit na hindi reflected sa kontrata namin na ang per day namin is php560.90 na? Mejo magulo din kase ang office policy namin e.

Also, is it legal na hindi kami bayaran for every holiday dahil sa bagong policy ng bank na "NO CALL OUTS, NO PAY"? We work as a CSR for a bank and kapag holiday daw hindi kami entitled for any holiday pay dahil kung wala daw kaming maipakita or maparinig sa twag namin for the day e hindi daw kami babayaran?

yung computation nang 13th month pay depende sa monthly gross nyo.. ni co compute yun monthly.. halimbawa:

For February ang daily rate nyo eh 456.00 tapos pumapasok kayo nang saturday.. Kung wala kang absent: so 456 x 26 = 11,856 / 12 = Php988.00 ang pro rated 13th month pay mo for Februray.

For August ang daily rate mo eh naging 560.90 so 560.90 x 26 = 14,583.40 / 12 = 1,215.28 ang pro rated 13th month mo for August..

tapos i add lang lahat yun up to December and then yun ang 13th month pay mo.

don sa holiday.. dapat bayad ang regular holiday.. yung special non working holiday lang dapat ang no work no pay.

Write written inquiry to your HR for basis of non payment of holiday pay. Was it stipulated in your job contract?If not, file non payment of holiday pay case at your DOLE office.

ask ko lang po. our 13th month pay and basic salary are in one payslip.
i have an excess of 6k for the 13th month non taxable.
ngayon po, ung excess na 6k sa 13h month ko at basic pay pinag combine a yun ang nilagyan ng tax. umabot ng 6,500 ung tax ko for this cut off. normally, nasa 3,500 lng ang tax ko kpag basic pay lang. nung nadagdag ung 6k na excess sa 13th month ko, halos dumoble ung tax ko. hindi po ba kinocompute ng hiwalay ung tax ng basic pay at tax ng excess ng 13th month pay? by the way S3 po ang status ko. hoping for your reply. thanks in advance!

dont worry.. i a annualize naman yang tax mo.. kung may overpayment yan ibabalik sayo as tax refund.

Meron pong prblem ung boyfriend ko sa compny nila..sinasabi ng company nila na may chance na hndi maibigay ung 13th month pay nila due to the financial problem of the company..then nalaman din nila na last year meron ding mga employee ang hndi nkatanggap ng 13th month pay nila..anu po kayang magandang action para dto..ngwoworry npo siya pati ung mga ka workmate nya lalu na darating ang pasko..

pag talagang may financial problem they should apply that first sa dole and dapat ma approve.. ask dole for help.

by law dapat ibigay ang 13th month pay on or before Dec. 24.

at gano katagal usually ang proseso kung magsasampa ng reklamo? ano po ang praktikal gawin kung magkagipitan at walang mailabas na 13th month pay ang kumpanya?

Kung ang kumpanya eh may financial problem, pwede nga silang hindi magbigay nang 13th month pero kailangan ipaalam sa DOLE... ngayon kung walang approval nang dole, hindi pwedeng hindi nila ibigay yan. So after Dec. 24, pwede kayo pumunta sa DOLE at magsampa nang reklamo.

ask ko lang po about labor law/code natin re 13th month pay. si misis ko po kc eh nanganak nitong october. ang balik nya po sa work eh after na po ng pasko. tama po ba na i-hold ng company ang 13th month pay nya kc po naka maternity leave sya and after pa ng christmas balik nya. salamat po.

hi! i would like to know how to compute my tax refund. i have been employed in a call center as sales and service rep. i started with 18 k basic, then it went up to 22 k upon regularization last Jan this year. in june my basic was 26 k. plus allowance 0f 3500. on top of these i earned commission and bonuses which varies. i checked my payslips from january to september (month i resigned), the sum of the taxes collected was around 65 k.

i would appreciate much if you could provide me any response. thanks!

you have to compute your tax due.. if tax collected is greater than tax due then you get a tax refund.
