Hi. I have an inquiry about the 13th month pay not given. Im working sabisang BPO company and i was on LOA for almost 3 months due to medical reasons. During that period pinapasweldo pa din ako. And now HR is saying that they have deducted the salary overpayment sa 13th month pay ko. My question is ano ba ang mga legal deductions sa 13th month pay? Yung salary over payment ba pwedeng ibawas sa 13th month pay or dapat ba sa mga susunod kong pay? Im still an active employee and just recently returned to work. Your prompt response is highly appreciated. Thank you!

your 13th month was given, they just deducted salary overpayment..

If you are absent then the payroll in-charge erroneously given you salary, the company may claim it from you.
