Hello po,

My husband is working in an agency and he was hired January 2017 and until now they did not receive their 13th month pay. Are they not entitled of that benefit?

they are unless it is already included in their monthly salary; check the breakdown. they should follow up with HR. they can also consider a money claim at dole.

Your husband should be entitled to 13th month pay kahit pa agency employee sya. All rank-and-file employees, regardless of the nature of their employment, are entitled to 13th month pay as long as they have already rendered at least 1 month of service. https://www.alburovillanueva.com/guide-labor-standards Nasa batas po yan, so kung hindi nila natanggap ang 13th month pay, meron syang cause para magreklamo sa DOLE.
