good morning po, last january 2013 pa po ako resigned sa company na to sinunod ko naman po ang lahat ng dapat na gawin bago umalis and nag turn over naman po ako ng maayos sa kapalit ko. after 3 months saka ko lang po natapos ang exit clearance ko sa kanila nakapirma naman po sila lahat pati na yung boss ko ang problem po after 2 weeks nag follow up po ako at sinabi nila na pina hold daw po ang last salary ko kasi hindi daw po ako nag endorsed dun sa kapalit ko at nung nakuha ko na po ung coe ko hindi po parehas yung nakalagay na position lumalabas na dinemote nila ako ng walang prior notice, may 3 contracts po akong pinirmahan sa kanila at lahat po yun ay parehas ang nakalagay ang position except sa coe ko. tapos po may inventory head po kasi na inassign yung dati kong boss, sya po ang nagsabi na dapat kaming magharap para ireconcile yung mga sinasabi nyang hindi ko daw inendorsed dun sa kapalit ko. e mag 4 months na ako wala sa kanila saka nya sasabihin yun at isa pa may proof po ako na pumirma yung boss ko na cleared ako. ano po ba ang dapat kong gawin? thank you very much po. since then hindi ko pa po sila nakakausap ulit.

if your concern is a coe, then i recommend you comply. if you can live without it and all you need is last pay, you can file a money claim at nlrc

so atty ibig po sabihin may right yung company na basta na lang ako idemote using coe without informing me? and dun sa last pay ko do i have the right na hindi na mag comply sa sinasabi nila na need ko pa pumunta dun para sa reconciliation na sinasabi nila e my clearance is already signed by all authorized signatories? wala naman akong dapat na ikatakot kasi po malinis naman po ang konsensya ko na wala akong kinukuha na hindi akin. thanks po.

I don't believe I said that.

the thing with a coe, there's no clear legal obligation on the part of the employer to issue one. consequently, there's no legal remedy to compel them to issue a new one. but i think you can write to your HR and point out the mistake.

oh i'm sorry po atty. i misunderstood what you've said. anyway, nagkausap po kami kanina ng former boss ko and he denied na sya ang nagpa hold ng last pay ko and tinuturo nya ako dun sa isang kapatid nya yun daw po ang kausapin ko, wala daw sya inuutos na ipahold ang last pay ko pero yung secretary nya ang tumawag sa acctg. dept. na ihold ang salary ko. i think naghuhugas kamay lang sya. and pinipilit pa rin po nung isang tao nya na head ng inventory na mag reconcile kami, i've passed all necessary reports she needed bago ako umalis and all the pending concerns ay na follow-up ko sa kanya nung andun pa ako sa kanila for 1 year and yet ang lagi nya sinasabi ay marami sya ginagawa kaya hindi nya maharap. i think its not my fault na hindi nya naireport dun sa former boss ko yung mga pinasa kong reports and concerns sa kanya kasi yun po ang trabaho nya in the first place. pero lumalabas ako ang masama at hindi gumawa ng work. feeling ko pinepersonal na ako nung inventory head na yun kasi may nakapag banggit sa akin na galit sya sa akin kasi po hindi ko daw sya ininform kung kelan ang last day ko, why would i do that hindi naman sya ang immediate boss ko. ano po ba ang dapat kong gawin? dapat na po ba ako mag file ng complain sa kanila or makipag reconcile na lang ako dun sa inventory head na alam kong may possibility na siraan nya pa ako dun sa former boss ko? thanks in advance po.

if you can tolerate it, i recommend just doing the reconciliation as quickly as possible to get it over with. else you can initiate a complaint at the nearest dole office

hindi po natuloy yung pag uusap namin nung in charge dahil ang dahilan nya busy daw po sya, hindi ko rin naman po maasikaso na lagi ako pupunta dun para lang kausapin sila hirap po ako mag follow up kasi wala po ako landline and hindi nila binibigay cel numbers nila. Ngayon po nag follow up na ako ulit sa accounting after ilang months tinataguan na dn ako ng in charge. dapat ko na po ba i-pursue talaga yung pag file ng money claim? thanks po.

i recommend you file a money claim at the nlrc or at the dole office.
