Atty., my co-workers arrive to office always late. Our Manager was then set a new policy regarding tardiness. Is it constitutional or not? and what exactly the articles on labor code was violated?

Official Office hours: From 8:30am-12:30pm then resume 1:30pm-5:30pm
Tardiness Equivalent:
*8:30-9:00 = 1 hour late
*9:00-9:30 = 2 hours late
*9:30-10:00 = 3 hours late
*10:00-10:30 = 4 hours or half day

Hi Atty,

I have big question about tardiness.... actually i am already not new in labor laws knowing that this is confusing to me... my company always have deduction for late on my monthly pay. My employer always saying, but the regular time of work is 9:00 am to 12:00 and 1:00pm to 7:pm straight...and I always come to office at 9:30 am.

I need help regarding this matter,for I know the in labor laws only require 8 hours of work. What action should I discuss with my employer to settle this problem.

If I were you, come at 9:00AM to avoid deduction.

Are you working on a compressed work schedule? Meaning, you work for more than 8 hours a day but you don't have a duty on Saturday and Sunday

8 working hours/ day is not required, 8hrs is the maximum working hours a day. any overtime required by the employer should be paid accordingly.

Yes. You can demand for an overtime. You may write a letter to your employer, if still, they wouldn't grant your request, you may request for a SENA hearing at DOLE

which comes first filling up the form 2316 or deduction?... i have been deducted of my BIR tax every pay day.. but i dont remeember i have filed an application for BIR form 2316.

Employer nag fifile ng tax ng empleyado nila.

Kaya ang requirement bago mag trabaho TIN number.

I agree kay Atty. Pumasok ka ng maaga. Para hindi ka malate.

Is it legal if pumasok ako ng maaga 9:00 am then mag off ng 7:00 pm.. 9hrs of work.. my boss is not paying OT, for the reason standard daw ng company working hours.... my point is i am making 9 hrs of work, still I have the deduction for late when i report at 9:30 am or 9:20 am?

How to do the best standard explanation with regards to labor law on regular working hours. should we follow the law or company system?

Actually our taxes goes to BIR to fund government projects.Unfortunately many of our taxes goes to NAPOLES..Makibalita ka rin sa TV, or radyo.

Sabihin mo s boss mo., magbasa ng batas (LABOR CODE). Kalokohan ka mo na 9 hours standard hours ng company nyo. 8 hours lang ang required ng batas, magtrabaho. Kung humigit ka dun at hindi bayad tawag dun nung time ng Kastila "POLO Y SERVICIOS"or sapilitang pagtatrabaho ng mga alipin. Modern day na tyo, kamo may batas na sinusunod.
Ngayon if sya naging boss ko, pasalamat sya hindi.

Irregardless of Lunch break, laging wlang bayad ang lunchbreak if normal workdays ka na 8 hours per day. Outside that conditions, compressed work week na yan tawag dyan. Ngayon merong policies dyan sa compressed work week na yan.
