Hi po,

Ako po ay meron kinakasama sa loob ng apat na taon, Siya po ay kasal sa iba ngunit hiwalay na ng halos 7 taon, samantalang ako ay hiwalay rin ng halos 13 taon. Sa ngayon po ay Nakatira kami sa partido ng pamilya niya, Siya po ay paalis ng bansa papuntang Saudi, Gusto po kasi ng kinakasama ko ng Mag-wan ng Last Will or SPA para sa akin upang ako po ang mangasiwa ng lahat ng may kinalaman sa papeles katulad ng SSS,PAGIBIG,OWWA at pati sa kanyang pinapaupang bahay at sa iba pang papeles na maaring kailanganin kung sakaling magkaroon ng problema, katulad ng kapag may mangyari sa kanya na di maganda sa ibang bansa, Ang mga nakasula sa mga papeles niya ay single at ang beneficiary at ung anak at ina lamang, hindi nya inilalagay ung kanyang legal na sawa dahil sila ay inabandona noon, sa ngayon ay gusto lang niyang makasiguro na Ako ang mangangasiwa kung anuman ang maaring maiwan niya sa akin at hindi makapaghabol ang unang asawa, gayun din sa kanyang maaaring mamanahin or magiging share niya mula sa pagbebentahan ng kanilang ari-arian. Ang tanong ko po ay kung ano po ba ang dapat naming ihanda na papeles para mapagtibay ang kanyang habilin kung sakaling magkaroon ng di magandang mangyari at para makasigurado na walang mahahabol o makukuha ung legal na asawa, SPA, Last WIll, or Video Message Recording po ba kaya ay puede na?

i have to say that his wife will still have the right to claim her share of their community property regardless of any document he executes. if he wants to make it legal, he has to get a judicial declaration of separation of property otherwise he will always be vulnerable to his wife coming out again and asserting her legal rights.

nevertheless, for administration of his properties, he can issue an SPA authorizing you, but if the wife shows up, you're out.
