Arresto Menor

Hi Attorney,

My husband is a seaman and has unclaimed salary and other benefits from his previous crewing agency, which was supposed to be released to him the day he arrived here in the Philippines but was not given because they said they do not have the money yet.

Before my husband left for another assignment, he left me a Special Power of Attorney authorizing me to sign/claim on his behalf his unclaimed salary but the crewing agency refused to honor the said SPA because they said my husband need to sign something in their office.

Do I have legal right to claim my husband remaining salary using the SPA?

Thank you very much for your attention to this.

Sol E.
