IBIG PO BA SABIHIN NOON SYA ANG MAGSISIGN IN BEHALF OF THE PRINCIPAL...BUT IF MAY MATATANGGAP NA CHECKS ANG PRINCIPAL SA KANYA NA PO BA IISSUE ANG CHECK...MEANING SYA NA PO BA ANG DAPAT SA PAYEE...O YUNG PRINCIPAL PA DIN.... AUTHORIZE LANG SYA MAG SIGN AT MAG CLAIM..

please don't use ALL CAPS.

It depends on what is written on the SPA. If he is empowered to receive the payments as per the SPA, then it is valid. If not, then the principal should expressly exclude it or tell the buyer that he is removing the authority of the agent to receive payments.

thank you....leave credits po kasi yung noong ka officemate ko na namatay.... since single po sya at wala na parents nya ang natitirang beneficiary nya yung sister nya. The sister is not in the philippines now,so she issued SPA to his son: 1. to act as representatives in claiming the burial benefits of the deceased brother and other benefits due to her brother; 2. To sign, deliver and execute any other documents necessary for the above purpose.

so the office should issued checks in the name of the sister or in the name of the son? thanks you.

to play safe, your office should issue it in the name of the legal heir, the sister, unless she issues a specific written authorization that the checks be issued in the name of the son, and that he has the authority to issue a quit claim.
