LAST PAY NEED SPECIAL POWER OF ATTORNEY

May kaibigan po ako na nag resign na s isang company at nagwowork na po xa abroad now. bago xa umalis pinagsabi nia if pwede yung mama nia kukuha ng last pay nia with authorization from her and all the I.D's needed para lang makuha back pay. Tas ngayon po ayaw ibigay ng Payroll Dept kasi kailangan daw ng Special Power of Attorney. Tas nung kukuha na po sila ng SPA hindi daw pwede na wala po xa kasi kailangan daw present nia while ngpapirma e nsa ibang bansa n po xa. Tanong ko lang po wala na po ba talaga chance n makuha yung last pay nia? by the way po lagpas 3 mos na po pla at hindi naibigay.

pwede sya kumuha ng SPA from the embassy where he is currently at. kung attested ng embahada ng pinas kung nasaan sya, walang rason para hindi ito tanggapin ng company. ipa-courier na lang nya sa nanay nya yung SPA.

ask ko lang po if pwede po ba ihold yung sahod ko kahit wala namn po akong pinirmahang contract kasi po nag trainning lang po ako ng 1 month then sabi po sakin na ihohold daw po muna nila yung salary ko makatarungan po ba yun?. thank you in advance po

nag training lang po ako then ang gusto po nila mangyari mag bigay po ako ng resignation and kailangan ko pa daw po mag pa clearance para daw po makuha yung sahod ko po.

kasi po traning po talaga nila is one month po then papapuntahin ka po sa office nila para sa extension po para namn po yun sa 5 months contract po eh hindi ko po grinab na po kasi po ang provincial rate nila is 342 sa kasamahan ko namn po rate nila is 350+ po same lang namn po kami ng trabaho pero magkaiba ng rate po.

Actually di pwede i hold ang salary unless there is a consent on your part.

The usual written consent can be found on the contract stating that you have a bond and if you were unable to finish the length of period required in your contract, your salary will be used as a payment to the training bond.

Since you don't have a contract, then you did not consent to having your salary on hold, and they should release it to you.

However, since umalis ka, salary is usually given as part of the final pay which you will receive after you are cleared of all your liabilities. So kung ibibigay naman nila after you finished clearance, there is no problem. If they did not give it to you, then you can file a complaint against them.
