hi there,i am newly hired in the company.
my contract that i signed said that i will be receiving a monthly basis worth Php9,990.00 plus allowances.Last past holiday our working days was from dec.15-dec.21 only because we have xmas vacation.whwn we received our salary they deducted dec.22 to 31.because they said we dont have work on that day,but they are the one (company)who said that we dont have work. we resume @ work at jan7 as they announced again but again they deducted the days (jan1-6)that we don have work. we believe we are fixed salary and they dont supposed to deduct us the days that they annunced that "no work".please help us to clarify.

sample payslip.period dec 16-31
gross income:
semi monthly basic 4,959
holiday -
ns 182.40
subtotal 5,141.40

less:
others 1,824 (this is the
one that they said,they deduct this bcos we dont have work for the days that they annouced tha we have no work)

add: allowances.


why do they have to deduct that?in a first place company is the one who announced that we hane no work for that days.Is it should be affected on a monthly basis salary contract?

.,.it happens always.

your company is correct, why would they pay you for the days that you don't have work? kung ikaw yung company papayag ka ba nang ganon? hindi nag work pero babayaran?

kahit monthly kayo.. it's still per day computation..

c. Basic Principle in Salary Payment: "NO WORK, NO PAY"

Unless specifically required by law, contract or established policy or practice, the employer is not bound to pay the salary to an employee who has not actually rendered any service.

You have to put yourself on your employer's shoes, it is tremendously unfair in the part of an enterprise, corporation or b.p.o. companies to pay a worker who did not render service.

A company reserves the right not to operate in any particular instance they deemed to be necessary.

It will again go back to an old cliche "If you can't stand the heat, get out of the kitchen.."

to naman base lng sa opinion ko sa previous ko na company pag holiday sa U.S. holiday din kami dito since the company is too generous we still get paid siguro it will depend on the company however kamusta naman yun if always na lng walang pasok, Smile

as per DOLE handbook:

Monthly-paid employees are those who are paid every day of the month, including unworked rest days, special days, and regular holidays while Daily-paid employees are those who are paid on the days they actually worked and on unworked regular holidays.

Nagkakatalo lang yan sa number of days worked per year, so affected and rate per day.

For Monthly Paid Employees = (Daily Rate x 365 days) / 12
For Daily Paid, my 3 types:
1. For those who are required to work everyday, including Sundays or rest days, special days, and regular holidays = (Daily Rate x 392.50) / 12
2. For those who do not work and are not considered paid on Sundays or rest days = (Daily Rate x 313) / 12
3. For those who do not work and are not considered paid onSaturdays and Sundays or rest days = (Daily Rate x 261) / 12

Ang difference lang eh yung computation nang Daily Rate nyo. Halimbawa ang basic monthly salary nyo eh Php15,000 a month.

If you are Monthly Paid ang daily rate mo eh Php493.15
If you are Daily Paid and you don't work on Saturday and Sunday, and daily rate mo eh Php689.66.

Pero in terms of getting paid on days you don't work, pareho lang yan, if you don't work, unless you have leave credits, walang bayad yan.
