Last Pay Check Staled or Expired

Nag-resign ako sa previous company ko effective last July 2011.
Na-process ko ung clearance ko November 16, 2012. When I followed up
with the company nung December 6, 2012, Nagulat ako na Stale (Expired)
na daw ung check ko. Tapos sabi nila na kailangan nila na i-request
ung new check for me. Medyo nagulat ako kasi hindi naman nila sinabi
na mag-generate na ng check for me. Ang aware po kami is makukuha ung
check after ng clearance. Sabi nila 1 month after ng resignation
nag-generate na sila ng check. Pero hindi naman nila nasabi un sa
akin.

Pwede po ba na mag-generate ang company ng last pay check kahit hindi
nag-clearance?

If ok lang sa kanila na mag-process ng final check, required ba sila
na mag-inform sa mga dating employee na ganun ang process nila dahil
posible na mag-expire ung check?

May maximum ba na panahon na pwede mag-claim ung employee?

If nakapag-clearance na, may maximum days ba para bayaran ng company
ung final check?

In an accounting perspective, they can and should generate the check within the year the person resigned. Expense for the year yun eh.

Kahit walang clearance. Assume na lang nila na hindi returned ang items issued to you (ID cards, etc).

They may not be required to advise you of anything. Besides, there was a miss on your part regarding the processing of your clearance. Dapat ginawa mo na yun nung July 2011.

Money claims - maximum 3 years.

Final check should be available within reasonable time (which may vary depending on situations).
