BACK PAY......

Good Day Atty.!!

Gusto k lang po sanang itanong sa inyo tunkol po sa back pay ko.. kung mgfile po ba ako ng kaso against my former employer can i get myself cleared and process my clearance for my back pay while case is in process?

if you file a case, it can be leverage to get clearance, but the danger is the more that they will refuse to give clearance and backpay

hi. i used to work for a BPO industry, i worked there for 8 months, i resinged due to haelth isues Im done with my clearance and all that. One of their staffs told me that i need to go come back after 2 months to pick up my check. 2 months later, i went there to pick up my check, only to find out that they dont have my records at all. they keep asking me to talk to hr and finance,but when i talk to them, all of them are pointing fingers. Until one day, one of the finance staffs told me to do the clearance all over again and wait for another 2 months. what is the legal action that i need to take?

Hi Atty... Is there a legal timeframe how long will be the issuance of your backpay? My case is almost the same as rockie_15.. Though in mine, after 4 months.. I was advised na negative pa daw ang backpay ko.. I was hospitalized before I resigned.. I have an approx 8 months of 13 month pay.. Im a regular employee.. I was only absent for 3 or 4 days.. and they said that they are deducting 10 days... What will be my step in filing a case against them Atty? As a backgrounder... Madami na pong different cases na nag file sa nlrc against this company....
