13th month pay on hold, is it legal?

hi! i resigned from my previous employment last october 31, 2012. i notified my employer october 8, 2012. wala pong clearance na dapat papirmahan ... kanina po, kiniclaim ko po ang 13th month pay ko, pero, on hold daw po as adviced by an area manager. yun po ang sabi ng oic na umuupo ngaun sa branch kung saan ako dati galing. tinanong ko bakit on hold, dahil daw po sa mga charge ko.. possible po ba na ihold ang 13th month pay ko becuse of charges? nung tinawagan ko ang area manager, d po nia sinasagot yung call at nagtext sa akin na alam ko na may charges ako at kaya ako nagresign dahil daw ayaw kong magpakaltas. pwede po ba na magkaltas sila ng certain amount sa salary ko na wala pong memorandum or acknowledgement galing sa kin?

yung charges po na sinasabi ng area manager, is yung mga bad accounts under my management dati... pero wala po akong acknowledegement or walang formal written notice galing main office na kakaltasan ako ng certain amount or walang memorandum regarding those charges...

why don't you talk with your area manager in his office in person? maybe you can settle these issues outright. if ever he refused, try to air your grievance with your human resources. and then tell hr that your area manager is deducting your bad accounts from your 13th month pay. i hope maayos ang gulo sa company pa lang ninyo. if all fails, go to field services division of regional offices of labor and file a complaint.
