Hi Gud pm po,
My previous employer put on hold my last salary. Spoke to my former HR Officer that it was the first time they hold the salary so meaning wla company policy to hold last salary only to quit claim/last pay and will process payment after proper turnover is done. I admit i still have pending report to submit due to beyond my control incidence. Can i insist to give me my last salary and only my quit claim will be hold.?

you can try but if they refuse then your remedy will be to file a complaint at nlrc.

Hello good evening po..
hingi lang po ako ng advice sa situation ko. I follow the company policy of 30 days notice if you will resign. During this 30 days period wala silang action na humanap ng kapalit ko, nag assign sila ng isang office-mate ko na mag OIC pansamantala para i turn-over ko lahat ng files ko ang unfinished works ko sa kanya, but ginawa nila ito last 3 days ko nalang sa work. meaning late na sila umaksyon. so ngayon wala na ko sa company they are demanding na hindi raw nila ako i-ke-clear at hindi nila ibibigay ang 13th month pay ko kung hindi ako bumalik at iayos ang pag turn-over ko at turuan ko daw ung bagong pumalit sakin. My question is tama po ba itong demand nila sa akin? meron po bang batas na may power silang i hold ang 13th month pay ko and other benefits? Sa ngayon po wala na ko sa company ang dami nilang ginawang report na di umano ay mga trabahong hindi ko raw ginawa kaya di nila ibibigay ang benefits ko. Am I still liable to do what they want kahit nagbigay na ko ng 30 days notice? please help me po.. thank you and more power..

hello again,
nagharap na po kami ng lawyer ng company sa Labor Office.. talagang they are demanding na bumalik ako dun at magturn-over daw ng mga files at magturo sa kapalit ko.. un din ang advise ng labor sundin ko nlang daw ung gusto ng former employer ko. gusto ng labor magkaayos nlang daw kami. parang feeling ko talo ako dito.. unfair ang nangyari sakin, sumunod naman ako sa 30 days notice sa kanila sila ang hindi umaksyon ng maayos sa resignation ko...medyo complikado na ang sitwasyon ko kaya hindi ko na kayang bumalik.. meron pa po ba akong pedeng gawin? o isusuko ko nlang ang karapatan ko? salamat po...

what if an employee was terminated due to awol, has not processed clearance due to ill feelings with management, is there any reason management will still withhold final pay. it has been one year since employee went on awol

dipo ba ang awol is absent w/o leave? bakit po ba siya babayayar kung basent siya? Twisted Evil

anywayz if ur employee is claiming for his wage/salary for his days worked, nararapat lamang na bayaran siya. Kung ang employer ay nakinabang sa pagod at pawis na ibinigay sa kanayang ng kanyang manggagawa nararapat lamang na ibigya din niya sa huli ang buo at taos puso niyang obligasyon Smile
