Hi,

Can this already be considered a libelous statement?

"hate you ugly bitch stepmom! dont ever think we are afraid of you, your face is only scary, it is past Halloween but your face is still scary!"

this was posted by someone outside of the family. funny when you read it but this didn't happen just once, remarks of the same nature have been posted before. the name is also not mentioned but anyone who reads it would know as to who it pertains to. do we have a case if ever?

the best way to avoid a libel charge is to do blind items because identification of the person maligned is an element of the offense. and the identification should be seen from the published article itself.

that said, what we once did for a client was to write a letter to the person doing blind items. while they never admitted that it was our client, being called out by a lawyer had the desired chilling effect
