Good evening, sir. Gusto ko lang po magtanong regarding sa case ko. Yung ex-boyfriend ko po kasi nag-record ng private moment namin, then in-attempt nya i-send sa isa sa mga kabarkada nya. I found out nung binuksan ko e-mail nya, nandun sa sent items nya. na-curious po ako, dinownload ko. Pagkakita ko nagulat ako kasi ako yung girl na nandun. Hindi nag-push-through yung pagsend ng video kasi mali po ata yung spelling ng email. Nakausap ko rin po yung friend nya na yun, ang sabi wala naman daw syang na-receive.

Galing na po ako CIDG kanina to file complaint, pero ang sabi sakin wala daw ako laban sa kaso kasi hindi pa naman daw consummated yung crime. Wala ako evidence na kumalat yung video. Ang sabi pa po sakin pwedeng ako pa raw ang kasuhan ng ex ko kasi ang lumalabas daw eh parang ako pa yung nagkalat about the video dahil sinabi ko yung nangyari sa dalawang kaibigan ko at kinuha ko yung copy ng video. Tapos ininvade ko pa raw yung privacy ng ex ko dahil binuksan ko yung email nya kahit na binigay pa nya sakin yung password at may consent nya.
Nagpadala na po ako ng invitation letter kanina sa ex ko from CIDG, pero sabi sakin pag hindi daw sumipot yung ex ko next week wala rin daw silang magagawa sa case ko.

Hindi ko na po alam gagawin ko. Gusto ko po ilaban yung kaso pero napanghihinaan na ko ng loob dahil sa simula pa lang mukang wala ng mangyayari. Sana po matulungan nyo ako.

very hard situation. and for the most part i have to agree with the cidg. i hope they were sensitive in talking with you.

he may have consented before to let you know his password, but I would argue that you are no longer authorized to access his email, especially because you are no longer together.

emails are forms of communication, and if attained in violation to the right to privacy, they cannot be used as evidence.

a letter has already been sent to him. that's evidence that you acted on this. hopefully, he will desist from continuing his acts.

pero sir nung time po na binuksan ko yung email na yun kami pa ng ex ko. may na-missent po kasi syang message sakin na about a video para sa friend nya, pero sabi nya wala lag daw yun. may hinihingi lang daw na porn video yung friend nya kaya nagsend sya thru email. after 2 days po nagbukas ako ng email namin to check both. na-curious ako dun sa video na sinasabi nya, so tinignan ko yung sent items nya. may video nga na sinend. dinownload ko tapos nung napanuod ko dun ko na po nalaman lahat.

Nahuli po yong binatilyo ng babae at pinahuli sa guard, na confiscate po ang cellphone at na detain sya sa police station overnight bago nakakuha ng bail. humingi ng paumanhin ang binatilyo sa reason na hindi nya sadya at ang family din ng binatilyo ay nag sorry din. Kaso after few days nagsampa pa rin ng kaso ang babae doon sa womens desk. Hindi po natanggap ang subpoena kasi nagtatago ang binatilyo sa takot makulong, tumigil din sa kanyang pagaaral. Tanong ko po ay ano ang maaring gawin para sa defensa or steps para ma settle? aapply ba rito ang full script ng RA9995? Maraming salamat po.

i don't know what you mean by full script, but ra 9995 is certainly applicable.

by the facts you mentioned, i don't see a clear defense.

you can approach the complainant and see if the 'civil aspect' can be settled.

good evening, attorney. nagpunta na po ako ulit sa cidg kanina, pero hindi sumipot yung ex ko. ayaw po tanggapin yung case ko, kasi pre-mature daw talaga. kesyo ako pa raw ang may gustong makipagbalikan kaya ko gustong magkaharap kami ng ex ko. ang gusto ko po talagang mangyari eh maparusahan sya. sinabi ko rin po yung psychological violence, pero ang sabi sakin kailangan daw ng 2 or more witnesses for the case to prove na may verbal abuse talagang ginawa sakin ex ko. saka dapat daw nag-file ako kaagad ng complaint at hindi ko na pinatagal. eh first week lang naman po kami nagkahiwalay ng ex ko. gusto ko po sana kumuha na ng lawyer, para mas malaman ko kung ano talagang gagawin. pwede po kaya akong mag-avail ng services ng PAO kahit ako yung complainant?

Ang ibig kung sabihin po ay hindi naman po na e publish ang video or naipasa sa iba dahil na confiscate naman po...e aaply ba lahat ang parusa na nakasaad sa description ng RA 9995?

Kung wala pong clear defense, ano po ang hahantungang parusa?

someone has to approach the complainant. if the complainant agrees, she has to file an affidavit of desistance before the prosecutor and affirm it in court after arraignment of the accused.

He has really the intention to take a video without consent. Yan ang napapala ng mga bastos na tao. You can't blame the woman if he will pursue with the case. Eh kung natuloy yung ma-upload sa vidio site like youtube, kawaw na man yung tao. Masisira yung confidence sa sarili. Di nya ba naiisip yon.

Kaya he has to face the consequences if his acts.

good day, attorney. i decided not to pursue the case anymore in the hopes na mananahimik na yung ex ko, but things hasn't changed. ayaw nya tumigil sa mga malicious posts at ng mga kaibigan nya sa facebook. nung october last year, nagkasagutan kame ng mga kaibigan nyang lalake sa facebook. puro kabastusan at at kababuyan talaga yung mga pinagsasabi nila. i'll send you a copy of the conversation. pwede ko po ba sila idemanda ng libel at kahit ano pang pwedeng ikaso sa kanila kahit na last year pa nangyari yung sagutan namin? kasi ayaw talaga nilang tumigil sa kakaparinig sa facebook. eh alam na alam naman ng mga common friends namin kung sino yung tinutukoy nila. thanks po.

Good day. Attorney. My apologies for not having this thread updated. This incident happened 2 years ago, but I'd like to know if I can still pursue the case - VAWC (against my ex) and Libel (against his friends) - now that we have the Cybercrime Prevention Act.To be honest, I still haven't moved on with what my ex did to me, as well as what his friends did. I'm really confused and don't know where to start again. I hope you can give me a little enlightenment. Thank you so much, Attorney, and more power!
