hello,

if my company gave NTE and follow the due process (twin notice) however they fail to advice me (in NTE) that I need to have counsel or representative on my hearing is that fall under Illegal dismissal? and let say u got terminated and you signed your Termination paper when it was served but missed to send the letter to your las known address will that fall under Illegal Dismissal? Can I argue that they didnt follow the proper due process?

if due process is the only fault, then the proper award is nominal damages, but the termination for a proven cause is still valid.
